Taking into account the advances in the administration of justice and the access that victims of the armed conflict have had to listen to and confront their perpetrators, Kham warned that he does not contemplate reopening the preliminary examination on Colombia. An example of this is that during four sessions, the former paramilitary commander, Salvatore Mancuso, answered all kinds of questions from the magistrates and the victims.

“What was the vehicle that Mr. Mancuso chose to speak to the Colombian people and to reveal his truth? Well, the JEP, as he (referring to Mancuso) acknowledges him and as this narrative unfolds, there will surely be room for new investigations and This has to be decided by the Colombian judicial authorities, you have the JEP and ordinary justice, we are just crossing the river of justice”he claimed.

In the middle of the round of questions, the prosecutor of the international justice organization was very clear in pointing out that they will only intervene in the country if there is no response from the institutions. In response to the request made a few months ago by the Government, headed by President Gustavo Petro, for the intervention of the ICC, Kham explained that Colombia “is not a failed state” for which, between the lines, he ruled out any action in the short term. .

“Unless it is determined that the country is not willing or does not have the capacity or does not want to act genuinely, I will continue to support the institutions of Colombia in that dynamic complementarity,” said the prosecutor of the International Criminal Court.

Faced with the Total Peace Project, one of the most ambitious of the Government, the ICC prosecutor acknowledged that it is not easy But not impossible. “You have a really vibrant civil society, protection is being given to so many marginal groups and you have identified the enormous progress that the Attorney General’s Office has made and the progress that the JEP has made.”

Faced with the main conclusions that have been reached during this visit, it is that the “JEP is not alone. We are technically supporting the JEP (…) The Government has promised to maintain its support, the Prosecutor’s Office also signed an internal document harmonizing work practices and the JEP”.
