The penalty was applied by Procon-RJ, which first fined the operator R$ 12 million, but even so, customers continued to receive excessive telemarketing calls from the operator.
Therefore, the judge Alcides da Fonseca Neto, from the 7th Chamber of Law of Rio, determined that the operator will no longer be able to make these calls on Saturdays, Sundays, holidays at any time in Rio de Janeiro. Calls will only be allowed on weekdays from 8:00 am to 6:00 pm, that is, during business hours.
In addition, the determination says that all calls cannot be made via private numbers and must be identified by the prefix 0303, which is already mandatory for all operators since June 2022.
It was also determined that Claro must maintain a register for customers who no longer wish to receive calls. If any of these rules are disobeyed, Procon-RJ’s guidance is that the complaint be made through its service channels with the following information:
- Customer contact number;
- Call date and time;
- Phone that made the call.
As an additional penalty, Claro will be fined BRL 1,000 for each telemarketing call made to its customers outside the permitted hours and days.
