Chile and Mexico Referral to ICC for War Crimes in Palestine

Through a statement, the Chilean Foreign Ministry reported that the Chilean ambassador to the Netherlands, Jaime Moscosopresented, together with Mexico, a letter of referral before the International Criminal Court (CPI) regarding the situation in Palestine.

“Considering that there is currently an ongoing investigation by the ICC Prosecutor’s Office regarding the situation in Palestine, the objective of Chile’s referral is to support the prosecutor in his investigation,” the statement added.

“What we are interested in is supporting the investigation of any possible war crime that has been committed in the area, wherever it comes from, whether they are war crimes committed by Israelis or Palestinians and war crimes that have been committed in the territory of Gaza, in the occupied territories of the West Bank, in East Jerusalem and also, by the way, in Israel.indicated the Minister of Foreign Affairs, Alberto van Klaveren.

“It is important to take into account that international humanitarian law refers to both the action of States and non-State groups,” he added.

“Accordingly, it refers to acts committed by the State of Israel, but also, certainly, to acts committed by the group Hamas through the terrorist actions that took place on October 7 of last year in Israeli territory,” he pointed out.

Meanwhile, the Mexican Ministry of Foreign Affairs indicated that the action of both countries “is due to the growing concern over the latest escalation of violence, particularly once morest civilian targets, and the alleged continued commission of crimes under the jurisdiction of the Court, specifically as of the attack on October 7, 2023carried out by Hamas militants and the subsequent hostilities in Gaza.”

“The intervention of the ICC takes on particular relevance given the numerous United Nations reports that report on very numerous incidents that may constitute crimes within the jurisdiction of the ICC in accordance with the Rome Statute,” stated the Mexican Foreign Ministry.

“Added to this is the practically total collapse of the national justice infrastructure of Palestine, which means that it would not be able to investigate or prosecute possible crimes committed in its territory or by its nationals,” he noted.

Let us remember that previously South Africa accused Israel, but before the International Court of Justice (ICJ) in The Hague, the highest UN court, of having “a genocidal intention” in its war in Gaza, demanding an end to the bombings on the Strip.
