Child Influencer Protection: New Law in Illinois Guarantees Income and Rights

Child influencers in the eastern US state of Illinois are now protected by a new law. It guarantees that a percentage of the money generated by the monetized videos in which they appear returns to them – otherwise, they can file a complaint.

This law, the draft of which was adopted in March in the Senate, was promulgated on Friday August 11, 2023. It will come into force on July 1, 2024. It applies to Internet stars under the age of 16, for videos shot in Illinois. The percentage of remuneration is defined according to the time during which “the image, name or photograph of the minor appears visually in the video”.

The parents, who generally film the videos, are obliged to set aside the gross income generated in order to return them to the child’s 18th birthday. This law is a first in the United States, as child labor on the Internet becomes an increasingly controversial subject, raising questions of ethics and safety. Other states may follow Illinois’ lead. In France, a law governing the work of child influencers was passed in 2020, also ensuring that their income is returned when they turn 18.
