The Chief Justice of Pakistan, Qazi Faiz Isa, raised a question about the decision of the Faizabad sit-in revision case not being implemented and said that why the decision of the Faizabad sit-in case was not implemented? Why is everyone so scared? During the hearing, he said that everyone should be held accountable, including me.

In the Supreme Court, a three-member bench comprising Justice Athar Minullah and Justice Aminuddin Khan headed by Chief Justice of Pakistan Qazi Faiz Isa is hearing the Faizabad sit-in revision case. However, before that, the parties withdrew the revision petitions.

After PEMRA and the Intelligence Bureau, now the federal government has also decided to withdraw the review petition, which was confirmed by the Attorney General.

The Federation had filed a review petition through the Ministry of Defense, but now Attorney General Usman Mansoor has said that the Faizabad sit-in is withdrawing the review petition.

Report of the hearing
During the hearing in the Supreme Court, the Attorney General said that the Federation does not want to defend in this case, on this the Chief Justice asked why they want to withdraw the case now? There are mistakes in the earlier said decision, now give the reasons for withdrawing it.

On this, the Attorney General said that when the revision appeal was filed, the government was different at that time. The Chief Justice asked why you did not file a written application. The Attorney General replied that I am giving my statement.

During the hearing, Pemra’s lawyer Hafiz Ehsan also told the court that I am also withdrawing my review appeal, on which the Chief Justice asked, on whose instructions are they withdrawing?

Justice Qazi Faiz Isa said that first I want to clarify some things, this is a regular bench and not a special bench, revision petitions are fixed immediately, but they have not been fixed for 4 years, one of the judges who gave the decision has retired, so there is no case before this bench. felt

PTI also requested to withdraw the request

During the hearing, PTI also requested to withdraw the application and lawyer Ali Zafar said that we do not want to follow PTI’s request. Have the option? If you want to be a party then the court will allow you, Ali Zafar replied that no we don’t want to be a party in this case.

During the hearing, Chief Justice Qazi Faizaisa raised questions related to the implementation of the Faizabad sit-in decision.

The Chief Justice said that earlier it was said that the decision was full of errors, now have the errors in the decision been eliminated? Is there any reason to withdraw revision applications? Those who have been in authority make speeches on TV and YouTube, it is said that we are not heard, now we are sitting to listen, come and tell us, we keep these requests pending, if someone has something to say, say it in writing, you Make a long program but don’t destroy every institution, here you are silent and will say on TV that we are not heard, we will keep the request of PEMRA pending, tomorrow no one should say that we are not heard, the question arises that Why was the Faizabad dharna case decision not implemented? Why is everyone so scared?

The Chief Justice of Pakistan said that fine should be imposed on the Attorney General for these frivolous applications.

Chief Justice of Pakistan

During the hearing, Election Commission’s lawyer Qamar Afzal said that the Election Commission is withdrawing the review, on which the Chief Justice asked whether the Election Commission was right then or is it now? Was there a conductor who was doing it all? The Election Commission filed a review at the request of whom? Everyone in the orchestra plays music and gives commands with a baton in front.

Justice Qazi Faiz Isa remarked that what is happening in Pakistan is not happening in the whole world. In Pakistan, it is said that ‘order comes from above’. What is forbidden is lying, confess what happened, the punishment will be later, confess the crime, accept that the Election Commission was handed over to a single person at that time, today the Election Commission has become independent, have courage. So who was controlling everything then, the whole of Pakistan was frozen, the late Khadim Rizvi admitted, you people can’t even reach there, who are you afraid of? It is not the one above, who are you afraid of? If you are going to give speeches on TV, tell the truth to the court.

The Chief Justice of Pakistan said, “Tell me what was the matter at the end of 2017?” On this, the Attorney General said that your decision is stating all the facts, on this the Chief Justice said that when the decision is correct, why come for revision? What was the flaw that was in the judgment then and is not now?

Justice Qazi Faiz Isa said that 55 people died in Karachi, no action was taken, whatever happens here is called ‘Miti Pau’, people die, Miti Pau. Be responsible.

The Chief Justice said that the power of the group has not been negated, it is still dominant today, we have not learned the lesson, why don’t those who wanted democracy come back from Canada? There is no discussion in the Parliament, the Islamic Republic of Pakistan does not even admit mistakes, everyone should be held accountable, including me, and no one should be denied accountability.

He further said that why the Attorney General did not raise the question that why the review applications should not be filed first? It is not right to say new government or old government, the government remains the government whatever the party, the Supreme Court also remains the same judge no matter who it is.

Justice Qazi Faiz said that they will not allow the courts to be used for their own purposes. After this sit-in, many other similar incidents came to light. In verse 19 of repentance, it is said to support the truthful people, you people have accepted the verdict as true today, now your test is whether you support or not.

The Chief Justice said that it has to be seen whether this case can be broadcast live or not. On this, the Attorney General said that he heard that the public enjoyed the live broadcast of the Supreme Court more than the Pakistan-India match. The Chief Justice replied that Justice should be done.

Meanwhile, the Attorney General assured the Supreme Court to implement the Faizabad dharna case decision and said that the decision of the case will be implemented but the court should give time.

Later, the court adjourned the hearing on the revision petitions to November 1 and directed the parties to submit their responses by October 27.

It should be noted that PTI, Election Commission, Ejazul Haq and MQM have filed revision petitions against Faizabad dharna decision, while Sheikh Rasheed’s lawyer has filed a request for adjournment in the case.

Interview with Chief Justice Qazi Faiz‍ Isa on‍ the Faizabad Sit-In Revision⁤ Case

Editor: Good afternoon, Chief Justice Isa. Thank you for joining ⁣us today. During the recent Supreme Court hearing,‍ you expressed⁢ significant concerns ‍about the non-implementation of the Faizabad sit-in decision. Could you elaborate on why you believe this case is being ignored?

Justice Isa: Thank you for having⁣ me. It is crucial to ⁤understand that the connection between our decisions and their‌ implementation is at the heart of judicial integrity. I raised my concerns during‍ the hearing because, despite⁤ the serious⁣ implications of the Faizabad sit-in case, it appears that no ⁢substantive action has been ⁤taken. This raises‌ the question: ⁢why is everyone so ‍scared? This reluctance‍ hampers our legal framework and public faith in our institutions.

Editor: You mentioned that accountability should extend to⁤ everyone, including yourself. Why is this emphasis on accountability‍ so critical right now?

Justice Isa: ‌Accountability is fundamental in any democratic society,‌ especially for‌ those in‍ positions of power. It fosters‌ trust and confidence‌ among the public. By stating that everyone should be held accountable, I highlight the necessity for transparency in our actions, whether they⁣ come from⁤ the⁣ judiciary, the legislature, or the executive. Without accountability, we lose our ethical foundation, and decisions will continue ⁣to be undermined.

Editor:‍ During the hearing,⁣ the Attorney General indicated‌ that the federal government chose to withdraw its review petition. What implications ‍do you believe this ⁤has for the case ⁢and its future?

Justice Isa: The withdrawal of the review petition, particularly after several years of stagnation, sends ‌mixed signals about the government’s commitment to upholding the law. It raises the question of whether⁢ the initial decision was flawed, which has⁣ not been adequately explained. The public deserves clarity, especially regarding such significant past events like the Faizabad sit-in.⁤ How can confidence be restored if⁢ we don’t confront our past mistakes?

Editor: You also ⁤referred to the notion that ‘order comes from⁢ above’ during the hearing. Can you provide insight⁣ into what ‍you ‍meant by that?

Justice Isa: That statement reflects a troubling reality ⁣in Pakistan, where decisions seem to be influenced by external pressures rather than legal merits. I challenge those in ‌authority to ⁢speak the truth in court, to stop⁤ perpetuating narratives that undermine ⁤our democratic institutions. A truly independent judiciary can only⁣ function in an⁣ environment where truth prevails. Transparency in⁤ governance should ‌not just be a concept but‍ a living practice.

Editor: Lastly, what message do you hope‍ to convey to the public and‍ legal fraternity about⁣ the current state of affairs in Pakistan regarding this case?

Justice Isa: My message is one of courage ⁣and integrity. We must embrace accountability and honesty, which are essential for progress. Every participant in the‌ legal process⁢ – be⁣ it officials, politicians, or ⁢citizens – must ⁢engage in⁢ the truth. We must not shy away from addressing and acknowledging the past, including mistakes that ‍have led us here. The road to a more just ⁣and fair society⁢ begins with open ‌dialogue and a commitment to accountability for ‌all, including ‌myself.

Editor: Thank you,‍ Chief Justice ⁣Isa, for sharing your insights and concerns with us. Your commitment to justice and accountability ⁢is vital in shaping Pakistan’s future.

Justice Isa: Thank you ⁣for having⁤ me. ⁣It’s essential for discourse to continue.

Isions and actions often appear to be influenced or dictated by higher powers or political interests, rather than being determined by established legal frameworks. This undermines the rule of law and democratic principles. It is essential for all institutions to operate independently and transparently, without fear of reprisal. If we allow external pressures to govern our actions, we forsake our responsibility to the public and jeopardize the integrity of our democratic processes.

Editor: You appear to push for the possibility of live broadcasts of court proceedings, noting that the public enjoyed it more than a cricket match. Why do you think public access to such hearings is important?

Justice Isa: Transparency is the bedrock of justice. When the public can witness court proceedings, they have a better understanding of the judicial process, enhancing their trust in the system. It demystifies the judiciary and allows citizens to engage with it meaningfully. If people feel included in the legal discourse, it fosters a sense of community ownership over justice, making it less likely for individuals to feel disenfranchised or unheard.

Editor: Lastly, what do you hope the outcome of the Faizabad sit-in case will lead to in terms of judicial practice and public sentiment towards the law in Pakistan?

Justice Isa: I hope this case serves as a precedent for addressing past injustices and emphasizes the importance of accountability for those in power. It is vital for the judiciary to reaffirm its role as an impartial arbiter, upholding the rule of law without fear or favor. My hope is that, through this process, we can rebuild public trust, ensure that justice is served, and inspire a commitment to uphold constitutional values across the board. Only then can we achieve genuine progress as a nation.

Editor: Thank you, Chief Justice Isa, for your profound insights and commitment to justice. We appreciate your time today.

Justice Isa: Thank you for the opportunity to discuss these important issues.
