According to recent announcements, targeted audits are being launched in companies by the competent services, with the aim of ensuring compliance with the provisions of the labor legislation.
The aim of the controls is to ensure the rights of the employees in terms of remuneration, the granting and payment of their leaves and the general observance of the labor legislation (eg the Easter gift), announced the Labor Inspectorate.
With its announcement, the Labor Inspectorate points out that from April 1, 2024 and without age discrimination, the Ministerial Decision is valid, which set the legal minimum wage at (830 euros) and the legal minimum daily wage at 37.07 euros.
It is also provided that for the increase due to seniority for those employees who are paid the minimum statutory salary or daily wage, the time of a dependent contract or employment relationship, which has been spent with any employer and in any specialty before 14.2.2012 and following, is recognized as seniority from 1.1.2024.
The above seniority increment is determined as follows:
- For employees with a dependent employment relationship, at a rate of 10% for each three years of service and up to three three years and a total of 30% for a service of 9 years or more.
- For artisans, with a dependent employment relationship at a rate of 5% for each three years of service and up to six three years and a total of 30% for service of 18 years or more
Employers must also submit to the “Ergani” Information System the change in salary, which is provided for by law or regulatory act or by a Collective Labor Agreement, such as in this case the increase in the minimum wage within 30 days of its implementation.
According to the newsit, for the submission of forms to the “Ergani” system, it is provided that the details of the employees who received the annual leave and the leave allowance for the previous calendar year 2023 are entered in the E11 form, until April 30, 2024.
The payment of the allowance Easter will be done until M. Wednesday. Holiday allowances may not be paid in kind, but only in cash.
For offending employers, the adjudication of said criminal cases is carried out by the autoforos procedure.
