Charting the Course: Your Essential Guide to Securing Encroached Properties

According, in particular, to what is provided in the decision:

  1. Redemption applications and the necessary supporting documents are submitted through a new Integrated Information System entitled “Requests for Redemption of Public Properties”. Access to the OPS is through the Unified Digital Portal of the Public Administration (gov.gr-EPSP) at the online address
  2. In the redemption application, the applicant’s name, VAT number, telephone number, postal address, e-mail address, as well as the public property to be redeemed, with reference to this law, as the case may be, are stated. If the application is submitted on behalf of a legal entity, the corresponding details of its legal representative are filled in. The takeover application is subject, for what is mentioned in it, to the position of a responsible declaration, in accordance with article 8 of Law 1599/1986.
  3. For each new application, a digital file is created, which includes all the data required by Law 5024/2023, which are registered in the OPS, as well as any files attached by the applicants when completing the application, grouped into categories.
  4. If the applicant is a natural person, the digital file of the application includes: a) Details of the public property, i.e. the type of property, ABK/AK/Tetha Number, KAEK territorial jurisdiction, OTA, KID.

b) The characteristics of the property, i.e. if it is within a plan, if it is in a border area, if there is a forest area >20%, the existence of any building/arbitrary construction or legalization, if it falls into a Natura/Ramsar/water habitat area, the type of area, the area to be purchased and the building area,

c) Building permit details (if any), i.e. building permit number, date of construction of existing building, which are attached, the objective value with the relevant calculation sheet,

d) Topographical diagram with integrated extract of orthophoto map and engineer’s responsible declaration.

e) A responsible statement from gov.gr or with a certified original signature that the exceptions to the possibility of redemption provided for by law do not apply.

f) A responsible declaration from gov.gr or with a certificate of genuine signature, in which the extent of the public properties to be acquired is confirmed,

g) Georeferenced file of the spatial footprint vector (zip, dxf or dwg) of the property dependent on the EGSA ’87 geodetic reference system with an attached engineer’s statement of Law 651/1977 and Law 1337/1983.

h) Excerpt of cadastral diagram and cadastral sheet of the property (KAEK).

i) Certification of building conditions from the competent building service.

j) Details of the location of the area to be acquired, i.e. the coordinates of the vertices of the acquisition polygon as a csv file, which is attached, a map focused on the above area.

k) Information regarding property ownership, i.e. titles and supporting documents, E9 declarations and ENFIA statements for the last five years preceding the submission of the application,

l) information justifying the discounts on the price provided for by law by attaching the relevant supporting documents,

m) additional supporting documents, in particular for the proof of possession of the public property.

n) e-paravolo in the amount of 300 euros, with the code to hold the paravolo.

  1. After the final submission of the application, OPS provides the possibility to monitor the takeover application at every stage, at which it may be until its approval or rejection.

THE SCHEDULE

The Regional Units of the country join the OPS for submitting applications with the following schedule:

A. On 30-9-2024 the Regional Units of Aetoloakarnania, Arcadia, Evros, Evia, Heraklion, Ioannina, Karditsa, Corfu, Larissa, Lasithi, Lesbos, Magnesia, Xanthi, Pieria, Rethymnon, Samos, Trikala, Fthiotida, Chania, Chios. The possibility to submit applications for these prefectures expires on 30-9-2025.

B. On 31-10-2024, all the other Regional Units are included. The possibility to submit applications for these prefectures expires on 10-31-2025.
