Charges after the near-attack at Vienna Central Station

The Vienna public prosecutor’s office has brought charges against the 17-year-old who went to Vienna Central Station with a combat knife on September 11, 2023 in order to carry out a terrorist attack in the name of the radical Islamist terrorist militia “Islamic State” (IS). However, he then refrained from his plan – and the prosecution also allowed him to withdraw from the attempt, as has now been explained in a press release.

“Since the accused voluntarily gave up his plan, the conditions for withdrawing from the attempt were met, which is why the investigation on suspicion of a terrorist offense according to Section 278c Paragraph 1 of the Criminal Code was discontinued for legal reasons,” said the public prosecutor’s office in a media release on Tuesday. This means that the terror plans announced by the suspected IS supporter in a chat but not carried out at the main train station are not the subject of the indictment and therefore will not be an issue in the main hearing to be scheduled.

The 17-year-old is accused of the crime of being a terrorist organization within the meaning of Section 278b of the Criminal Code. According to the 29-page indictment, which is available to the APA, he is said to have worked for IS from January 31, 2023 to September 12 at the latest, “by carrying out a large number of attacks on various social media or in private chats “Glorified and propagated the terrorist organization IS-Islamic State and its goals, including in particular armed jihad.” 15 chats or messages were included in the indictment, including statements by the boy that he had posted in a Telegram group with 28 IS supporters immediately before the trip to the main train station. In halting English he told his like-minded people “I will make inshallah attack in Vienna”. When asked when he would do “it”, he replied: “Im doing today”, posting a photo of himself in the chat with a hunting knife, gloves and in camouflage clothing next to an IS symbol spray-painted on the wall. logo showed.

The extensive investigations and interviews with the accused revealed “that the young person acted out of conviction and in accordance with the goals of the terrorist organization Islamic State,” the public prosecutor’s office stated in its broadcast. The boy’s statements during the investigation that he had “lost courage” at the main train station were consistent with the rest of the evidence, writes the public prosecutor’s office.

In the upcoming trial, the punishment for the previously innocent person is up to five years’ imprisonment, taking into account the age of the defendant. The indictment is not yet final and the defendant has the right to lodge an objection with the court within 14 days of service of the indictment.
