The female insurance clerk always believed that the customers of the hairdressing salon came and went, and that the family’s infection had nothing to do with her; the family members jointly claimed 3,597,379 yuan from her. A total of 3,073,775 yuan was given to 16 plaintiffs.
The verdict pointed out that Hu Nu and “Grape Mother” were good friends in the singing class. On May 8 last year, they went to Huatan National Liyuan Wedding Banquet Hall to attend a wedding banquet. They had close contact with each other at the same table. In the middle of the night, the test results of “Grape Mom” were confirmed, and the next day, the Changhua County Government issued a notification of isolation for the contacts of “Grape Mom”.
The verdict stated that Ms. Hu knew that she had been banned and was not allowed to go out, but concealed her contact history. On the 13th, she went to the hairdresser run by Ms. Xu to sell the epidemic prevention policy, and she did not wear a mask during the period. As a result, Ms. Xu became infected. Then the infection spread, Xu’s in-laws, parents and 2 sons were also affected, and Xu’s in-laws and parents infected other family members. A total of 16 people in the whole family were diagnosed successively.
The amount of compensation requested by Xu’s family is in accordance with the standards of the epidemic prevention policy. The most compensated is Xu’s. She lived in a negative pressure isolation ward for 30 days (with a daily payment of 9,000 yuan), and was quarantined for another 13 days. The hairdresser was closed for 43 days. , a total of 588,865 yuan in compensation was awarded.
The second highest compensation was Xu’s husband. He spent 21 days in the negative pressure isolation ward and was unable to work for 46 days. He was awarded 366,866 yuan in compensation. Xu’s eldest son stayed in the negative pressure isolation ward for 21 days and was awarded 322,222 yuan in compensation. Her second son was hospitalized for 26 days and was awarded 279,551 yuan in compensation.
For other family members who are not admitted to the negative pressure isolation ward, the compensation amount is regarding 100,000 to 200,000 yuan depending on their income.
Ms. Xu’s parents, who run a family business with a relatively high income, shut down their business for half a month following being infected with the epidemic, and requested 640,000 yuan in compensation for operating losses, but the court believed that the amount was too high and 122,400 yuan was reasonable. The entire case is still subject to appeal.
