The applicant is Xu Jianyun (transliteration, English name: Hui Kin Wan), and the respondent is the Hong Kong Housing Authority. Xu applied for the Priority Housing Allocation Scheme as an “elderly single person” in 2021 but was rejected. A social worker wrote to him twice, saying that his savings were exhausted and he might not afford to rent a bed. He also suffered from back and bone pain and prostate problems because of his degenerated legs. He hoped that the Housing Authority would allow him to apply for public housing. In July and September last year, it was rejected by the Housing Authority on the grounds that it was not eligible for application.

Xu submitted another application in March this year, saying that his savings were only 704 yuan. The Housing Authority replied in April, stating that he had accepted compensation and chose to arrange his own housing. According to the “Application Notes”, he may not be eligible to apply for public housing, which made him face obstacles in applying for transitional housing and was also ineligible to apply Cash benefit pilot scheme.

Xu believed that the relevant policy was too rigid, did not take into account his financial difficulties and physical deterioration, and was suspected of being unconstitutional and illegal, so he demanded that the relevant policy be overturned, as well as the decision of the Housing Authority to reject his application for public housing in April this year.
