The Guinean opponent, Cellou Dalein Diallo, was in Lille in the north of France, Saturday October 21, 2023. During the meeting, organized for this purpose, the former minister of transport, Cellou Dalein Diallo denounced the award of contracts over the counter in the awarding of road construction projects in Guinea. For the president of the Union of Democratic Forces of Guinea (UFDG), all public contracts, “practically 95% are awarded by direct agreement”. A practice that has become common since the CNRD took power on September 5, 2021.
“There is not often a preliminary study,” deplores the opponent who explains that a construction project requires a study called Preliminary Project Summary (APS) which precedes the execution study. According to Cellou Dalein Diallo, the call for competition is obligatory since, he says, the Market Code is an organic law in Guinea. “Any public expenditure whose amount exceeds 20 million Gnf must be the subject of a call for competition. Either you make a shortlist of five companies with proven capabilities, you tell them to make an offer each, or you make an open call for tenders published in the international and local press. There is a commission which will carry out the examination to choose the offer which presents the best in terms of Quality-Price (…) Once the contract is awarded, you recruit a consulting engineer through competitive bidding. And it is the consulting engineer who must approve the invoices.”
The CNRD led by Colonel Mamadi Doumbouya has been splashed by several scandals. The most recent case is the contract to renovate the Prime Ministers’ residence. “There is regular denunciation of over-the-counter markets in Guinea. It is a violation of the law, which is an organic law, the Market Code, but also a distortion in competition. There are companies that pay taxes that are specialists. When we say equality of opportunity also in access to markets (…). You take a friend and you say I’ll give you this deal, how much you give and you negotiate between you since there are generally no specifications. There is no competition. The roads, if you do not follow this procedure which guarantees the execution of the project in accordance with the specifications, you call your friend because he supports the government or the junta, naturally the product does not meet the standard. People are very motivated by personal enrichment through retro commissions,” believes Cellou Dalein Diallo.
“I challenge anyone every project I have done, there have been fights sometimes. No section was given by direct agreement. There were calls that were made regularly. There was a counting and attributions. And we have always ensured that projects are executed on budget and on time. I was considered as someone who ensures the execution of projects in compliance with specifications, deadlines and budget,” boasts the opponent in exile.
