CC suspends appeal against Arévalo’s decision and confirms governor of Quetzaltenango

The Constitutional Court (CC) confirmed on Monday, July 22, the appointment of the departmental governor of Quetzaltenango, Aldo Herrera, by definitively suspending an appeal by the Foundation Against Terrorism (FCT) that sought to nullify the appointment made by President Bernardo Arévalo.
The appointment of the substitute governor Mayra Leticia López Sosa is also confirmed.
The FCT based its appeal on the fact that President Bernardo Arévalo’s decision allegedly did not comply with the requirements of the Executive Branch Law because the president should have taken into account the candidates proposed by non-state representatives of the Departmental Council for Urban and Rural Development of Quetzaltenango.
According to the CC’s resolution, the protection was definitively suspended because the FCT did not comply with indicating to the Court whether these appointments were made in the same government agreement or whether they were made separately.
“In the course of the matter, this Court, by resolution of June 25, 2024, granted a three-day period for the applicant to clarify the challenged act, in the sense of indicating whether the appointment of the titular and alternate governor was contained in the same Government Agreement, or whether each was appointed in different agreements,” the resolution details.
On this account, the CC decided to declare the definitive suspension of the protection raised.
“The Constitutional Court (…) enforces the warning contained in the resolution of June 25, 2024; as a result, it definitively suspends the processing of the amparo filed by the Foundation Against Terrorism Guatemala, through the President of the Board of Directors and Legal Representative, Ricardo Rafael Méndez Ruiz Valdés, against the President of the Republic of Guatemala,” the resolution says.
