A nationwide settlement has been reached in several class-action lawsuits involving two types of drugs and some Canadians might get a chunk of the money.
The lawsuits have raised various claims once morest the narcotic prescription drugs OxyContin and OxyNEO, seeking damages for damages and injuries allegedly related to opioid use.
OxyContin and OxyNeo have both denied the allegations made in the lawsuits.
Courts in Ontario, Quebec, Nova Scotia and Saskatchewan agreed to a $20 million settlement.
Who is eligible for settlement?
According to a press release from the law firms, the settlement applies to any Canadian who was prescribed and took OxyContin and/or OxyNEO tablets anytime between January 1, 1996 and February 28, 2017, that were manufactured, marketed, and/or sold in the country.
This includes the following counties:
- Ontario Class: Those whose prescription was issued in Ontario and/or British Columbia
- Quebec class: Those whose prescription was issued in Quebec
- Atlantic Canada Class: whose prescription was issued in Nova Scotia, Newfoundland and Labrador, New Brunswick, and/or Prince Edward Island
- Saskatchewan class: whose prescription was issued in Saskatchewan, Alberta, Manitoba, Yukon, Northwest Territories, and/or Nunavut
A $20 million settlement payment has been created.
The money will be used to pay regional health insurers’ claims, settlement notice costs, compensation for people who are approved to file a claim, and legal fees.
The money will be paid to class action members who show they have “suffered one or more of the injuries described in more detail in the compensation protocol, all of which are subject to different eligibility criteria and maximum payment values.”
Note that not all class action members are eligible for compensation.
The types of injuries that may be eligible for reimbursement include fatal and non-fatal overdoses, addiction, and various complications arising from the use of OxyContin and/or OxyNEO.
