Access to health products plays an important role in people’s ability to stay healthy. Any problems accessing these products can cause hardship for individuals and their families, in addition to putting a strain on our health care system.
It is therefore a priority for the Government of Canada to ensure that Canadians have access to the medications they need, when they need them.
In keeping with this commitment, we have put in place regulatory safeguards and continue to preserve the domestic drug supply, including by protecting it from foreign bulk import programs. The government believes that importing large quantities of drugs for the Canadian market is not a solution to high drug prices in other countries.
Under the Food and Drug Regulations, prescription drugs intended for the Canadian market cannot be sold and exported for use in other countries if doing so would cause or worsen shortages in Canada. This ban applies to businesses, such as manufacturers, wholesalers and distributors that hold a Pharmaceutical Establishment License (DEL) issued by Health Canada.
A DEL holder who intends to sell or export a drug intended for the Canadian market for use outside the country may only do so if he or she demonstrates that the sale will not cause or harm will not worsen a shortage of the drug in Canada.
