Manama > A new federal law to employ domestic workers in the UAE will come into force on Thursday. The law guarantees a suitable working environment for domestic workers in accordance with the law of the country and international agreements.
The Ministry of Human Resources and Emiratization announced on Wednesday that the law establishes a comprehensive framework to strengthen and regulate labor relations for the recruitment and employment of domestic workers in the UAE and defines responsibilities in a manner that protects their rights and duties.
The law was announced on October 5 last. Under the new law, domestic workers can carry their personal identification documents (including passports). The law strictly prohibits the recruitment or employment of domestic workers below the age of 18. Ministry of Human Resources license mandatory for recruitment or temporary work. The law prohibits recruitment agencies, directly or through third parties, from charging commissions or charging fees for employment.
Recruiting domestic workers from their own country without informing them regarding the nature of work, salary and other benefits is also prohibited. Evidence of physical fitness, health condition, mental and professional status of the recruits should be made available to employer in advance. Employment contract should be made as per Mantralam format. The contract should specify the financial obligations of the employer to bring the worker to the UAE and the recruitment agency fees.
In case the recruitment agency violates the conditions, an alternative worker should be provided. Otherwise the recruitment fee should be reimbursed to the employer. In this case the employer can seek damages from the agency for damages caused by the breach of contract.
Recruitment agencies should treat domestic workers humanely. Don’t attack them. The employer is obliged to provide suitable accommodation, food and clothing. The employer must treat the domestic worker properly, protect their dignity and physical fitness and pay them according to the employment contract. The employer must pay the medical expenses or health insurance cover for the employee.
The employer must provide the domestic worker with a return flight ticket once in two years. If both parties agree to terminate or not renew the employment contract following the annual leave, the domestic worker should only be given a one-way ticket to their home country. The worker must perform the work under the direction and supervision of the employer and in accordance with the employment contract. The domestic worker must respect the privacy of the workplace. They must protect the employer’s property, work equipment, and all things in their custody and not use them for outside work without the employer’s permission.
