Burger King will have to defend itself in court following a lawsuit was filed once morest the restaurant chain saying Whopper burgers look bigger than they really are.
The company unsuccessfully asked a judge to dismiss the appeal, according to the New York Post. Thus, Miami judge Roy Altman declared that Burger King had to defend itself from the actions it is accused of through this class action.
Customers who filed the lawsuit say the fast-food chain allegedly reprized its burgers with ingredients that “overflowed the bun.” This would suggest that they are 35% bigger than they are, which would constitute a breach of contract with customers.
To defend itself, the company emphasizes that it is not required to offer a product that is identical to the one in the photo.
Note that the McDonald’s and Wendy’s restaurant chains are the subject of similar actions in Brooklyn.
