“I request the lifting of the ban and allow the immediate resumption of X’s activities” in Brazil, states Judge Alexandre de Moraes in his decision.
Moraes allowed Elon Musk’s platform to reopen in Latin America’s largest country after he deemed it complied with all legal obligations.
These included the payment of a fine totaling 28.6 million reais (about 4.8 million euros) and the suspension of accounts deemed to be spreading fake news. The company was also forced to appoint a legal representative in Brazil.
“X is proud to return to Brazil (…) We will continue to defend freedom of expression, within the limits of the law, everywhere we operate,” the platform said.
Moraes gave Brazil’s telecoms regulator Anatel 24 hours to restore access to the medium used by 22 million Brazilians.
Musk had announced on August 17 the closure of X’s offices in Brazil, although the platform continued to operate in the country.
The judge banned access to X on August 30, finding that the platform had ignored orders to block accounts that allegedly spread disinformation, which was mainly linked to the Brazilian far-right and belonged to bloggers, entrepreneurs, journalists or former parliamentarians.
After Twitter was bought by Musk – who renamed it X – the platform has been accused not only in Brazil but also in other countries of taking a lax stance on disinformation. Critics of the social network also accuse it of being reduced to a mouthpiece of the far right.
“We showed the world that here the laws must be respected regardless of who you are. Brazil is a sovereign state,” Communications Minister Juscelino Filio said in a statement a few hours after the judge’s decision.
