Bolívar Administrative Court orders its suspension

According to what was stated in the judgment of the Bolivar Administrative Court, The demand originated from the fact that the payment of four years of legal management in the collection of the portfolio was not recognized.

This is how the ruling reads: “The contractor was unfairly deprived of his right to execute the contract under the agreed conditions, and due to the non-liquidation of the same in the post-contractual stage, his contract was injured. right of credit which was the expected gain.

Several signed amendments are also listed, in accordance with the ruling, between Electricaribe and the law firmin which the energy trading company, now in liquidation, says that “it will respect the procedures carried out by the contractor on the portfolio assigned to it, from its beginning to its completion, in such a way that if its actions result in a collection in favor of Electricaribe, the agreed fees will be canceled”.

Luis Armando Mola Insignares, owner of the firm Mola Lawyer Group S.A.She told THE HERALD which is suing the State, the Superintendence of Residential Public Services and the former company Electricaribe, for the non-compliance with portfolio collection on March 4, 2016.

According to Mola, it was ordered to establish a legal reserve for $28 billion, which is the value of the claims in the lawsuit. He added that in this process the Superintendent of Public Services, Natasha Avedaño Garcia, and the liquidator of Electricaribe, Ángela Patricia Rojas Combariza, with the objective that if the State is convicted of breaching the contract to be paid, the country could repeat against them.

Faced with such controversy, the owner of Mola Lawyer Group indicated: “I am looking for a breach of the contract to be declared, since it was terminated arbitrarily by the current liquidator of Electricaribe without justifying the established grounds.”

In addition, Mola Lawyer claims that said breach be paid for “compensation for lost profits and damages”, since they were 4 years dedicated to legal management and at the moment in which all the most important legal processes were giving results, Ariza decides to terminate the contract in an abusive manner, damaging interests and assets.
