The administration of the President of the United States, Joe Bidenofficially decided not to veto the decision of the US International Trade Commission (International Trade Commissionor ITC) which prohibits imports of Apple Watches For the country.
Thus, the ITC order comes into force today (12/26), preventing both the import and sales of models that have technology to measure blood oxygen levels — which, in this case, includes Apple Watches Series 9 e Ultra 2.
The decision was communicated by the US trade representative, Katherine Taiaccording to information from Archyde.com. Apple can (and will), however, appeal the ban to the US Court of Appeals for the Federal Circuit.
Sales
The models affected by the decision had sales suspended in the US Apple Store Online last Thursday (12/21), with the Apple store indicating that the devices are currently unavailable.
Until Christmas Eve (12/24), however, they might still be found in the company’s physical stores across the US; not anymore. Third-party resellers, it is worth noting, will still be able to sell these models — but, with imports prohibited, this will depend on the units that each retailer has in stock.
There are also reports that Apple Stores have received new marketing materials to promote the Apple Watch SEwhich will continue to be available because it does not have a blood oxygen sensor.
Process
Apple announced the interruption in sales of the aforementioned Watch models in the United States as a result of a lawsuit between it and the medical monitoring technology company Fields.
More precisely, Masimo accused Apple of hiring its employees, stealing its pulse oximetry technology and incorporating it into the Apple Watch.
Masimo has indicated it is willing to negotiate, but Apple believes the patents are invalid and does not want to pay royalties. To “get around” the ban, however, the company intends to make software changes that might allow the watches to return to the shelves.
However, it may take some time for Apple to prepare the update and receive government approvals (or not…) to release it.
