#BezKitu campaign – The image of the rule of law in Poland. Comments by Hanna Suchocka and prof. Włodzimierz Wróbel

Andrzej Duda, referring to the case of Mariusz Kamiński and Maciej Wąsik, said that “we are dealing with the terror of the so-called rule of law.” – It is good to live under the terror of the law, not under the terror of an autocrat – commented former Prime Minister Hanna Suchocka in a special edition of the “#BezKitu Campaign” on TVN24. As she pointed out, “one should submit to the dictate of the law, not the dictate of politics outside the law, which is turning into authoritarian power.” – If the president is afraid that the law is in force, I wonder what might be the reason for such fear – added Supreme Court judge Prof. Włodzimierz Wróbel. He emphasized that “either you are governed by the law, or the law rules.” As he explained, “the law is governed by the autocrat and he is not afraid of it, because it is an instrument to force others to behave in a certain way.” Guest Radomira Wit also commented on the separation of powers. Suchocka noted that “the authorities penetrate each other, but there are certain spheres that cannot be penetrated and a certain distance must be maintained.” However, prof. Wróbel was asked regarding what was happening in the Supreme Court. – It will be quite trivial to say that the Court does not function as it should – he replied. Among the reasons, he pointed out that “organizationally, there are two political institutions, created by politicians for political decisions.” As he continued, “dysfunctions also appear due to the fact that the Supreme Court is headed by a person who was appointed to this position in an unconstitutional procedure.”
