The Brussels civil court handed down two judgments on Tuesday, condemning the Belgian state for having detained two students, one Moroccan and the other Congolese, for several days in a closed center. The two students believed that they had been the subject of an illegal decision and claimed to be compensated, which was granted to them.
Junior Masudi Wasso, a student of Congolese nationality, was arrested by airport police in Zaventem on September 18, 2021. Holder of a visa “long stay“and having a valid registration at UCLouvain, the young man was nevertheless placed in the Caricole closed center in Steenokkerzeel. He spent 16 days there before being released.
Ouial Ziti, a student of Moroccan nationality, enrolled in the 5th year of dental medicine at the University of Iasi in Romania, had the same experience on December 13, 2021, following a check carried out by the airport police in Gosselies . The student was however in possession of a French visa in order, with which she had already gone several times to Belgium, where several members of her family reside.
The court simply noted the illegality of these decisions. Regarding Junior Masudi Wasso, he states that this one “might not be turned back by border control authorities“Regarding Ouiam Ziti, the court notes in particular that the arguments mentioned to justify his detention”are not legally permissible grounds that might justify the detention“, and, as to the other grounds, that they are “of a general and stereotyped nature, making it impossible to establish that the administrative authority carried out a concrete and individualized examination“of the situation of the young woman.
