Jamiat Ulema-e-Islam chief Maulana Fazlur Rahman has said on Wednesday that there was an objection to the amendment of Article 8 regarding fundamental rights in the draft of the proposed constitutional amendment, due to which he did not support it.

In a meeting with TV anchors and journalists at his residence in Islamabad, Maulana Fazlur Rahman discussed his party’s objections to the recently proposed constitutional amendment, the features of the Federal Constitutional Court, the extension of the tenure of the Chief Justice and the Army Chief, the powers of the military court. And discussed the political situation.

Maulana Fazlur Rahman said that the proposed government amendment had ‘twisted’ Article 8 of the Constitution due to which the powers of the army had been increased.

Clause 8 of the Constitution mentions the repeal of laws contrary to fundamental human rights and sub-clause 3 mentions those things where protection of fundamental rights will not be provided. Maulana Fazlur Rahman’s main objection was the amendment of sub-clause 3 of Article 8.

According to Kamran Murtaza, it was being further strengthened under the amendment of sub-clause 3, after which security was also being provided to the army and the places used by the soldiers.

According to sub-clause 3 of the present Article 8 of the Constitution: ‘On any law relating to the proper performance or discipline of members of the armed forces or police or other bodies responsible for the maintenance of public order. And by maintaining discipline.’

Maulana Fazlur Rahman said that we refused to amend this article.

On another proposed amendment regarding the army, Maulana Fazlur Rehman said that an amendment was also proposed in Article 243 of the Constitution, which would provide constitutional protection to the services chief.

Senator Kamran Murtaza, who was present there on this occasion, said that ‘service chiefs could not be de-notified after this amendment.’

According to Maulana, apart from this, Article 51 and 106 were being amended with regard to specific seats, which was supposed to benefit his party, but he disagreed with it in principle.

Maulana Fazlur Rahman’s party also expressed its objection to the amendment of Article 63-A, which is related to the membership of members of the Assembly.

His party also objected to Article 200 regarding transfer of High Court judges. Explaining his objection in this regard, Jamiat Ulema-e-Islam leader and jurist Senator Kamran Murtaza said that, in principle, his party has no objection to allowing the transfer of High Court judges, but the current amendment gives this impression. He said that his party has no objection in principle to the establishment of the Federal Constitutional Court. He also said that all the parties have agreed on the establishment of this court in the past.

Giving further details, Maulana Fazlur Rahman said that ‘the government has expressed its willingness to withdraw from the amendment of Article 8, 63-A and the clause regarding specific seats.’

Maulana Fazlur Rahman was asked whether Nawaz Sharif contacted him for consultation before the amendment. On this he said that ‘no one consulted, Shahbaz Sharif came but he only spoke of support.’
