Aurore Bergé and Agnès Firmin Le Bodo received the report on visiting rights in EHPADs, at the end of an eight-month mission entrusted to Laurent Frémont, teacher at Sciences-Po Paris and founder of the Tenir ta main collective.
Through this mission, the ministers wanted to honor the memory of all the people who died in EHPADs during Covid-19, in the absence of their loved ones.
Drawing on around a hundred hearings from families and professionals in the medical-social sector, and several thousand testimonies, this report reviews the restrictions on public freedoms which led to deprivation of visits. The mission documents their consequences on residents, relatives and professionals, in the absence of final farewells and funeral rites.
The report suggests ways to reestablish the “alliance” between loved ones and institutionsin particular the inclusion of visiting rights in the law, the establishment of an annual information day on rights and recourses, the facilitation of external appeals and the development of knowledge in matters of ethics and palliative care .
In response to this report, Minister Aurore Bergé recalled:
“We know the importance for people to live their entire lives, surrounded by their loved ones. Laurent Frémont’s proposals respond to a deep need for collective progress to ensure both respect for rights and consideration of the emotional and social needs of older people. Next week, the examination of the proposed law on aging well will resume and through this law, we will enshrine the right of visitation in the law as Laurent Frémont recommends. The bond with loved ones is the heart of life: we understand that well.”
After reading the recommendations, Minister Agnès Firmin Le Bodo underlined the need to strengthen respect for the right to private and family life of people hosted in social and medico-social establishments and services.
