Through Resolution 16763 of 2024, the Ministry of National Education established the maximum increase limits for enrollment and pensions that private educational establishments must apply for next year.

Bogotá DC September 30, 2024. The Ministry of National Education established, through Resolution 16763 of September 30, 2024, the increases applicable to the tuition and pension rates of private preschool, basic and secondary educational establishments in the country that will be applied in the school year. 2025.

Through this regulation, the maximum increases in monthly enrollment and pensions that non-official educational establishments may apply to provide the service for the next year are set.

As established by the Educational portfolio, the increase base will be set in accordance with the Consumer Price Index – CPI as of August 2024, issued by DANE, which was located at 6.12%.

From there, each educational establishment will be able to access additional fixed percentage points, according to the following criteria:

  • Permanence index. According to the 3 variables that are part of the index, regarding the behavior of the registration registered in the Registration Information System – SIMAT for the years 2022 and 2023, it can be located in the following ranges:

Additionally, private educational establishments will be able to access percentage points for the following concepts:

  • Implementation of inclusive education strategies in accordance with Decree 1421 of 2017 that report enrollment in SIMAT with students with disabilities, with which they will be able to receive an additional 0.25%.
  • Private educational establishments that support that the salary payment of at least eighty percent (80%) of their educators is subject to the teaching scale of Decree 2277 of 1979, may increase an additional 1.6 percentage points in the costs. education by 2025.

According to this, the increases in educational costs for private schools in 2025 will range between 6.28% for a school located in a Controlled Regime and with a low permanence rate and to which the additional points for inclusive education do not apply and salary level agreement; up to 9.27%, for a school located in Regulation due to quality certification, high permanence rate, inclusive education and salary leveling with Fecode.

The Ministry of Education also clarifies that it is the Certified Territorial Entities that will issue the administrative acts for setting the rate increase for 2025 before they begin their enrollment process, clearly specifying the regime in which each educational establishment is located. Likewise, it is important that each educational establishment clearly specifies the increase percentages that it will apply and that parents investigate and confirm the correct application of the increase according to the different variables.

On the other hand, within the framework of institutional autonomy, private educational establishments may grant discounts to families on the authorized rate. These discounts must be detailed in the regulations or coexistence manual, recorded in the enrollment contract and reported in the profit and loss statement of the educational establishment the following year in the self-evaluation process.

Additional considerations

Resolution 16763 of 2024 additionally indicates that although it is true that in the event of not receiving timely payment of tuition fees or pensions, private educational establishments may retain student evaluation reports, unless The parents or those responsible for this obligation can demonstrate the impossibility of payment for just cause, under no circumstances may they retain the students in the SIMAT, suspend the provision of the service, or prevent them from participating in the educational process, which includes submitting evaluations and/or or recoveries, remove them from the classroom, participate in pedagogical activities, and other academic activities.

Likewise, it establishes that private schools may not engage in restrictive practices when requesting educational materials, forcing the acquisition of supplies, texts or uniforms of specific brands or preventing the competition of multiple suppliers; and that the lists of school supplies must be made known well in advance.
