As announced by the Ministry of Labor, they start today the applications of businesses affected by the devastating fires of the previous days for suspension of employment contracts.
Specifically, as of today, Tuesday, August 1st is PS ERGANI available for the submission of declarations of suspension of the employment contracts of the employees by the companies – employers who saw their businesses destroyed by the fires.
The employees, whose employment contract is suspended, are entitled to an extraordinary financial aid, as a special purpose compensation, in the amount of 534 euros. Employees whose employment contracts are suspended are provided with full insurance coverage.
The announcement of the Ministry of Labor:
I. FOR THE IMPLEMENTATION OF THE MEASURE OF SUSPENSION OF LABOR CONTRACTS OF EMPLOYEES OF FIREWORK COMPANIES
A. Pursuant to article 70 of Law 5045/2023 (Α΄136), companies – employers of the private sector, regardless of sector and business activity, in areas affected by forest fires, whose facilities are completely destroyed or seriously damaged material damage to the extent that it is not safe to provide work within the workplace, and are certified as such by the relevant Region (or other relevant agency), may suspend the employment contracts of their employees, who were hired until the previous day from the occurrence of the fire, until the restoration of the damages caused due to it and in any case no more than three (3) months.
In particular:
The administrative limits and the corresponding dates of application of the measure of the suspension of employment contracts as above are specified as follows:
a. The affected businesses – employers belonging to the administrative boundaries of the regions:
of the Municipal Communities of Loutraki-Perachora and Isthmia of the Municipal Unit of Loutraki-Perachora and of the Municipal Community of Agioi Theodori of the Municipal Unit of Agioi Theodori of the Municipality of Loutraki-Perachora-Agioi Theodori of the Regional Unit of Corinthia of the Region of Peloponnese,
of the Municipal Community of Kouvara of the Municipal Unit of Kouvara of the Municipality of Saronikos of the Regional Unit of Eastern Attica of the Region of Attica
of the Municipal Community of Mandra of the Municipal Unit of Mandra and the Municipal Community of Oinoi of the Municipal Unit of Oinoi of the Municipality of Mandra – Idyllia of the Regional Unit of West Attica of the Region of Attica, of the Municipal Unit of Magoula of the Municipality of Elefsina of the Regional Unit of West Attica of the Region of Attica,
of the Municipal Communities of Pyli and Stefanis of the Municipal Unit of Dervenochoria of the Municipality of Tanagra of the Regional Unit of Boeotia of the Region of Central Greece,
may suspend the employment contracts of their employees who were hired until 7/16/2023, from 7/17/2023.
b. The affected businesses – employers belonging to the administrative boundaries of the regions:
of the Municipal Units of Kameiros, Attavyros, Lindia, South Rhodes, Rhodes, Kallithea, Ialyssos, Petaloudon, Afantou and Archangelos of the Municipality of Rhodes, the Regional Unit of Rhodes of the South Aegean Region, the Municipality of Megarea, the Regional Unit of Western Attica, the Region of Attica, may to suspend the employment contracts of their employees who were hired until 7/17/2023, from 7/18/2023.
c. The affected businesses – employers belonging to the administrative boundaries of the regions:
the Municipal Community of Platanistos of the Municipal Unit of Karystos and the Municipal Community of Komito of the Municipal Unit of Kafirea of the Municipality of Karystos of the Regional Unit of Evia of the Region of Central Greece, the Municipal Community of Rafina of the Municipality of Rafina-Pikermio and the Municipal Community of Nea Makri of the Municipality of Marathon of the Regional Unit Eastern Attica, the Region of Attica, the Municipal Communities of Kassiopi, Sinion and Nisaki of the Municipal Unit of Kassopaia and the Municipal Communities of Loutsa, Perithia and Lafki of the Municipal Unit of Thinali of the Municipality of North Corfu of the Regional Unit of Corfu of the Region of the Ionian Islands
may suspend the employment contracts of their employees who were hired until 7/22/2023, from 7/23/2023.
d. The businesses – employers of par. 1 that belong to the administrative boundaries of the regions:
of the Municipal Communities of Almyros, Krokios and Platanos, of the Municipal Unit of Almyros of the Municipality of Almyros, of the Regional Unit of Magnesia and Sporades of the Region of Thessaly, of the Municipal Communities of Velestinos, Agios Georgios and Aerinos, as well as the Supervisor of the Municipal Unit of Feren of the Municipality of Riga Feraio of the Regional Unit of Magnesia and Sporades of the Region of Thessaly, of the Municipal Units of Volos, Nea Ionia, Aisonia, Nea Anchialos and Makrynitsa, of the Municipality of Volos of the Regional Unit of Magnesia and Sporades of the Region of Thessaly may suspend the employment contracts of their employees who were hired until and on 7/25/2023, from 7/26/2023.
B. Beneficiaries of Special Purpose Compensation – Amount of special purpose compensation
Employees, whose employment contract is suspended, are entitled to extraordinary financial aid, as special purpose compensation, in the amount of five hundred and thirty-four euros (534 euros), which corresponds to thirty (30) days, in proportion to the days of the suspension of their employment contracts, as well as a proportion of holiday allowances.
Employees whose employment contracts are suspended are provided with full insurance coverage, calculated on their nominal salary, for the period of suspension of the employment contract, as well as for the holiday allowances corresponding to this period.
C. PROCEDURE FOR SUBMISSION OF STATEMENTS OF SUSPENSION
C1. BUSINESSES – EMPLOYERS
Businesses, employers are obliged to submit a responsible declaration every month to the P.S. “ERGANI”, with which they declare the employees whose contracts are suspended.
Depending on the administrative region to which each affected business-employer belongs, one of the following special cases of responsible statements is selected:
Businesses – employers affected by the fires of 17/07/2023 in the areas belonging to the Regional Units of Corinth, East, West Attica and Boeotia
Businesses – employers affected by the fires of 18/07/2023 in the areas belonging to the Regional Unit of Rhodes and the Municipality of Megareo of Western Attica
Businesses – employers affected by the fires of 23/07/2023 in the areas belonging to the Regional Units of Evia, Eastern Attica and Corfu
Businesses – employers affected by fires of 26/07/2023 in the areas belonging to the Magnesia Regional Unit.
NOTE: The condition of maintaining jobs provided for in par. 3 of article 70 of Law n. 5045/2023 (Α΄136), does not apply to seasonally employed workers.
C2. EMPLOYEES
After the first declaration of suspension of the business-employer, the eligible employees submit a responsible declaration on the electronic platform
Employees submit a responsible declaration ONLY once and are not required to re-submit their declaration for the remaining months.
It is noted that in the case of employees whose employment contracts have been suspended in the past (as part of another emergency measure), regardless of the employer, it is not required for the employees to resubmit a responsible declaration, unless they wish to change their bank details account (IBAN).
D. DEADLINES FOR RESPONSIBLE STATEMENTS FOR THE MONTH OF JULY 2023
PS ERGANI will be available for the submission of declarations of suspension of the employment contracts of the employees by the companies – employers, as above, for the month of JULY 2023, from 1/8/2023 to 11/8/2023.
E. DEADLINES FOR RESPONSIBLE STATEMENTS FOR THE MONTH OF AUGUST 2023
PS ERGANI will be available for the submission of declarations of suspension of the employment contracts of the employees by the companies – employers, as above, for the month of AUGUST 2023, from 12/8/2023.
Especially for employment contracts of employees that are suspended during the period from 1/8/2023 to 21/8/2023, the responsible declarations of companies are submitted within the period from 12/8/2023 to 21/8/2023 2023.
For employment contracts of employees that are suspended from 22/8/2023 onwards, the notice of suspension applies.
F. The deadlines for submitting unilateral declarations for any cases of employees whose employment contract was terminated by notice from companies – employers subject to the provisions of article 70 of Law 5045/2023 and who according to paragraph 5 of the same article are beneficiaries special purpose compensation in the amount of 534 euros per month, from the date of termination of the employment relationship and for a period not exceeding 3 months, will be announced in a later announcement.
II. EXTENSION OF THE MEASURE OF SUSPENSION OF LABOR CONTRACTS IN THE FUR INDUSTRY DEADLINES OF RESPONSIBLE STATEMENTS FOR THE MONTH OF AUGUST 2023
From 12/8/2023, the ERGANI program will be available to businesses – employers active in the Fur industry affected by the consequences of the war in Ukraine according to No. 67806/19-7-2022 (Β΄3796) KYA as its validity was extended by Decree No. 69144/25-7-2023 (Β΄4811) KYA, for the submission of declarations of suspension of employment contracts of their employees for the month of August 2023.
Especially for employment contracts of employees that have been suspended during the period from 1/8/2023 to 21/8/2023, the responsible declarations of the companies are submitted within the period from 12/8/2023 to 21/8 /2023.
For employment contracts of employees that are suspended from 22/8/2023 onwards, the notice of suspension applies.
