The Investigative Police Agency of the Ministry of Public Security also issued a decision to prosecute the accused, a restraining order from leaving his residence, and a search warrant against Nguyen Thi Hong Tham, Chairman of the Board of Directors and General Director of Xuan An Company Limited.
On the same day, the Supreme People’s Procuracy (Case 5) approved the above Decisions and Orders. The Investigative Police Agency of the Ministry of Public Security has executed the order to arrest the accused for temporary detention and search in accordance with law.

The results of the investigation determined that, from May 2017 to the end of December 2022, Bac Giang Mineral Company (led by Mr. Duong Van Dung, Chairman of the Board of Directors as the legal representative) together with Co., Ltd. MTV Xuan An (by Mrs. Nguyen Thi Hong Tham, Chairman of the Board of Directors cum General Director, legal representative) exploited coal at Bo Ha coal mine in excess of the allocated reserve, causing damage to State property. .
