HAVING SEEN File No. EX-2024-59795839- -APN-DGGRH#MT, the Permanent Complementary Budget Law No. 11,672 (TO 2014) and its amendments, Decrees Nos. 167 of March 2, 2018, 50 of December 19, 2019 and amendments, 565 of October 31, 2023 and its amendments, 198 of February 27, 2024, Resolutions of the former MINISTRY OF SOCIAL DEVELOPMENT Nos. 121 of March 18, 2020 and its amendments and 1,625 of November 8, 2021, Resolution of the MINISTRY OF HUMAN CAPITAL No. 84 of April 9, 2024, and

CONSIDERING:

That through article 108 of Law No. 27,431 and its amendments, incorporated into the Permanent Complementary Budget Law No. 11,672 (TO 2014) and its amendments, the power of the NATIONAL EXECUTIVE BRANCH to create Temporary Special Executing Units and/or to manage plans, programs and projects of a transitory and exceptional nature, being able to determine the structure, operation and allocation of human resources that correspond, establishing that said units will have a duration that does not exceed TWO (2) years, and may be extended as long as they are provided for in the budget of the year following the expiration of the term.

That through article 1 of Decree No. 167/18, the Ministers were empowered to create, in their respective areas, Temporary Special Executing Units under the terms of article 108 of Law No. 27,431, and to appoint their holders, after the intervention of the NATIONAL DIRECTORATE OF ORGANIZATIONAL DESIGN.

That by Resolution of the former MINISTRY OF SOCIAL DEVELOPMENT No. 121/20 and its amendments, the NATIONAL PROGRAM FOR SOCIO-PRODUCTIVE INCLUSION AND LOCAL DEVELOPMENT – “POTENCIAR TRABAJO” was created.

That by article 1 of Decree No. 565/23 the LABOR INCLUSION PROGRAM was created within the scope of the then MINISTRY OF LABOR, EMPLOYMENT AND SOCIAL SECURITY, in order to promote training and strengthen the formal work system of people who are working in the field of the Popular Economy.

That through article 1 of Decree No. 198/24 the aforementioned LABOR INCLUSION PROGRAM was replaced by the RETURN TO WORK PROGRAM, within the scope of the SECRETARIAT OF LABOR, EMPLOYMENT AND SOCIAL SECURITY of the MINISTRY OF HUMAN CAPITAL, in order to develop and consolidate a level of socio-labor skills for its beneficiaries, which allows them to reach a real initial employability level and improve their opportunities for job insertion through their participation in job training activities, training practices in work environments and assistance in the development of individual or associative productive ventures, as well as established in article 4 that the NATIONAL PROGRAM FOR SOCIO-PRODUCTIVE INCLUSION AND LOCAL DEVELOPMENT – “POTENCIAR TRABAJO” will remain in force until the MINISTRY OF HUMAN CAPITAL completes the transfer and distribution of all of its holders to the RETURN TO WORK PROGRAM or to the SOCIAL SUPPORT PROGRAM.

That by article 1 of the Resolution of the MINISTRY OF HUMAN CAPITAL No. 84/24 the General and Operational Guidelines of the Return to Work Program were approved and by article 3 of the aforementioned Resolution it was established that the SECRETARIAT OF LABOR, EMPLOYMENT AND SOCIAL SECURITY is the implementing authority of the RETURN TO WORK PROGRAM.

That, likewise, Decree No. 50/19 and amendments, assigned to the UNDERSECRETARY OF EMPLOYMENT AND LABOR TRAINING, dependent on the SECRETARY OF LABOR, EMPLOYMENT AND SOCIAL SECURITY of the MINISTRY OF HUMAN CAPITAL, the objectives of participation in the formulation, design, implementation, monitoring and follow-up of policies, plans, programs and actions for the promotion and maintenance of employment, permanent job training and the improvement of employment and employability conditions of the unemployed and underemployed.

That, within this framework, it is pertinent to create the Temporary Special Executive Unit “EXECUTIVE UNIT OF THE RETURN TO WORK PROGRAM” within the scope of the UNDERSECRETARY OF EMPLOYMENT AND LABOR TRAINING of the SECRETARY OF LABOR, EMPLOYMENT AND SOCIAL SECURITY of the MINISTRY OF HUMAN CAPITAL, which will be in charge of coordinating the management and execution of the RETURN TO WORK PROGRAM.

It is considered necessary to establish that the EXECUTIVE UNIT OF THE NATIONAL PROGRAM FOR SOCIO-PRODUCTIVE INCLUSION AND LOCAL DEVELOPMENT POTENCIAR TRABAJO”, created by Resolution of the former MINISTRY OF SOCIAL DEVELOPMENT No. 1,625/21, will remain in force until the tasks and procedures necessary for the completion of the administrative actions and procedures in progress related to the implementation of the NATIONAL PROGRAM FOR SOCIO-PRODUCTIVE INCLUSION AND LOCAL DEVELOPMENT POTENCIAR TRABAJO are completed.

That the aforementioned Unit will be dissolved TWO (2) years after the entry into force of this measure, in accordance with the provisions of Permanent Complementary Budget Law No. 11,672, and its amendments.

That, Dr. PALOMINO, Luis Alberto (DNI No. 14,769,401), meets the conditions of suitability and experience necessary to efficiently fulfill the responsibilities and functions of the aforementioned Unit.

That the Permanent Legal Service dependent on the SECRETARIAT OF LABOR, EMPLOYMENT AND SOCIAL SECURITY of the MINISTRY OF HUMAN CAPITAL, has taken the intervention of its competence.

That the LEGAL UNDERSECRETARY and the ADMINISTRATIVE MANAGEMENT UNDERSECRETARY, dependent on the LEGAL AND ADMINISTRATIVE COORDINATION SECRETARY of the MINISTRY OF HUMAN CAPITAL, have taken the intervention within their competence.

That the NATIONAL DIRECTORATE OF ORGANIZATIONAL DESIGN of the MINISTRY OF DEREGULATION AND TRANSFORMATION OF THE STATE and the NATIONAL BUDGET OFFICE of the UNDERSECRETARY OF BUDGET of the SECRETARIAT OF TREASURY of the MINISTRY OF ECONOMY have taken the intervention that is their responsibility.

That this measure is issued in accordance with the powers conferred by Articles 1 and 2 of Decree No. 167 of March 2, 2018 and Article 3 of Decree No. 198 of February 27, 2024.

Therefore,

THE MINISTER OF HUMAN CAPITAL

RESOLVES:

ARTICLE 1.- Article 7 of Annex I approved by Article 1 of the Resolution of this MINISTRY OF HUMAN CAPITAL No. 84 of April 9, 2024, shall be replaced by the following:

“ARTICLE 7.- The SECRETARIAT OF LABOR, EMPLOYMENT AND SOCIAL SECURITY of the MINISTRY OF HUMAN CAPITAL, through its dependent UNDERSECRETARIAT OF EMPLOYMENT AND LABOR TRAINING, will be the Implementing Authority of the RETURN TO WORK PROGRAM.”

ARTICLE 2°.- Article 3 of Resolution No. 84 of this MINISTRY OF HUMAN CAPITAL dated April 9, 2024, shall be replaced by the following:

“ARTICLE 3°.- It is established that the SECRETARIAT OF LABOR, EMPLOYMENT AND SOCIAL SECURITY of the MINISTRY OF HUMAN CAPITAL, through its dependent UNDERSECRETARIAT OF EMPLOYMENT AND LABOR TRAINING, will be the implementing authority of the RETURN TO WORK PROGRAM and may issue the regulatory and complementary administrative acts that are pertinent and sign the agreements necessary for the implementation of the aforementioned Program and the achievement of its objective.”

ARTICLE 3.- The Temporary Special Execution Unit “RETURN TO WORK PROGRAM EXECUTIVE UNIT” is hereby created within the scope of the UNDERSECRETARY OF EMPLOYMENT AND LABOR TRAINING of the SECRETARY OF LABOR, EMPLOYMENT AND SOCIAL SECURITY of the MINISTRY OF HUMAN CAPITAL, which will be in charge of coordinating the operational management and execution of the RETURN TO WORK PROGRAM.

ARTICLE 4.- The Temporary Special Execution Unit “RETURN TO WORK PROGRAM EXECUTION UNIT” will have the following objectives:

1. Coordinate the registration process of the beneficiaries of the RETURN TO WORK PROGRAM on the devices designated for this purpose.

2. Intervene in the planning of the scheme of benefits for job intermediation, guidance and training and promotion of salaried, independent and self-managed employment, to be offered to the beneficiaries of the RETURN TO WORK PROGRAM.

3. Coordinate with the areas of the SECRETARIAT OF LABOR, EMPLOYMENT AND SOCIAL SECURITY with competence in the matter, the actions and procedures necessary for the implementation of the RETURN TO WORK PROGRAM, as well as the execution of the benefits scheme.

4. Promote the signing of agreements with national, provincial, AUTONOMOUS CITY OF BUENOS AIRES and municipal public bodies or entities, universities, educational institutions, actors in the field of production and work, and/or all types of civil society organizations with experience in addressing employment and job training issues, which allow strengthening the range of benefits to be provided to beneficiaries of the RETURN TO WORK PROGRAM.

5. Manage the processes for receiving, processing and resolving queries and complaints from beneficiaries of the RETURN TO WORK PROGRAM.

6. Intervene in the administrative and management circuits linked to the application of suspensions or terminations of beneficiaries of the RETURN TO WORK PROGRAM.

7. Propose adaptations or improvements related to the execution of the RETURN TO WORK PROGRAM and intervene in the implementation of these in the devices associated with the Program.

ARTICLE 5°.- The Temporary Special Executive Unit “RETURN TO WORK PROGRAM EXECUTIVE UNIT” will be in charge of an official outside the level with the rank and hierarchy of National Director, Level A – Grade 0, Executive Function I of the Sectoral Collective Labor Agreement of the Personnel of the NATIONAL PUBLIC EMPLOYMENT SYSTEM (SINEP), approved by Decree No. 2,098 of December 3, 2008, its amendments and supplements.

ARTICLE 6°.- The Unit created by article 3° of this measure will be dissolved TWO (2) years after the entry into force of this Resolution.

ARTICLE 7.- Dr. PALOMINO, Luis Alberto (DNI No. 14,769,401) is hereby appointed to the position of Head of the Temporary Special Executive Unit “RETURN TO WORK PROGRAM EXECUTIVE UNIT” within the scope of the UNDERSECRETARY OF EMPLOYMENT AND LABOR TRAINING of the SECRETARY OF LABOR, EMPLOYMENT AND SOCIAL SECURITY of the MINISTRY OF HUMAN CAPITAL.

ARTICLE 8.- The Temporary Special Executive Unit “EXECUTIVE UNIT OF THE NATIONAL PROGRAM FOR SOCIO-PRODUCTIVE INCLUSION AND LOCAL DEVELOPMENT POTENCIAR TRABAJO” will remain in force until the tasks and procedures necessary for the completion of the administrative actions and procedures in progress related to the implementation of the NATIONAL PROGRAM FOR SOCIO-PRODUCTIVE INCLUSION AND LOCAL DEVELOPMENT POTENCIAR TRABAJO are completed.

ARTICLE 9.- The expenses required by this measure will be covered by the specific items of the current budget of Jurisdiction 88 – MINISTRY OF HUMAN CAPITAL – Subjurisdiction 03 – SECRETARIAT OF LABOR, EMPLOYMENT AND SOCIAL SECURITY.

ARTICLE 10.- This measure will enter into force on the day of its publication in the OFFICIAL BULLETIN OF THE ARGENTINE REPUBLIC.

ARTICLE 11.- Register in the INTEGRATED SYSTEM OF INTERNAL REGULATIONS (SINI) of the SECRETARIAT OF LABOR, EMPLOYMENT AND SOCIAL SECURITY.

ARTICLE 12.- Communicate, publish, give to the NATIONAL DIRECTORATE OF THE OFFICIAL REGISTRY and archive.
