Applying for H-2B Work Visa: Everything You Need to Know

The United States Embassy in Bogotá announced that Colombia was included in a special annual allocation of 20,000 H-2B temporary work visas, which will allow Colombians to legally apply for work in the United States.

Through its X account, the Embassy assured that “this assignment represents the commitment of the Biden-Harris Administration to expand legal channels as an alternative to dangerous irregular migration routes.”

According to the United States Government, the H-2A and H-2B visa programs allow US employers to bring foreign nationals to the United States to fill temporary agricultural and non-agricultural jobs, respectively.

How to apply for an H-2B visa?

  • The US employer must first file a petition on your behalf, this is listed as an entity supplement.
  • If you are interested, you must have a valid passport and sponsorship from a company in the North American country. That is, the company must manage the employment certification request.
  • The employer must demonstrate that there are not enough U.S. workers who are able, willing, qualified, and available to do the temporary work.
  • Employing H-2A workers will not adversely affect the wages and working conditions of similarly employed Americans.
  • As with the H-A2 visa, the worker may stay for a maximum of 3 years, in accordance with the US Government.
