Vivar’s lawyers pointed out that the Powerbeats Pro’s charging problems may be due to both the design of the charging case and the lack of strength of the “ear pads”. In addition, it also pointed out that the waterproof and sweat-proof functions promoted by Apple are also impossible, and the sweat on the earphones may corrode the charging contacts. The plaintiff’s request is for Apple to “correct” the problem as soon as possible and pay compensation for affected users and various damages. If the lawsuit is won, consumers in eight states outside New York, including Georgia, Michigan and Virginia, will be able to receive compensation.

Apple has not yet responded to the matter.
