Appeal to the court to stop the possible detention of Imran Khan’s army

Pakistan Tehreek-e-Insaf (PTI) as its founding chairman Imran Khan A petition has been filed in the Lahore High Court on Thursday against possibly being handed over to army custody for trial.

In the petition filed in the Lahore High Court by Imran Khan’s lawyer Aziz Karamat, it was stated that there is a fear of Imran Khan being handed over to the army for trial in the May 9, 2023 cases.

In the petition, the stand has been taken that the civil courts in the country are working according to the constitution and law, so the trial of Imran Khan is being heard. Military courts Instead of doing it, it should be ordered to continue in the civil courts.

Federal Government, Federal Investigation Agency (FIA), IG Jails Punjab, Superintendent Police, Adiala Jail and IGs of all four provinces have been made parties in the petition.

The petition further states that ‘the founder PTI is the former Prime Minister of Pakistan, who was subjected to the most state repression after his removal from office in April 2022.’

According to the petition: ‘He (Imran Khan) has been named accused in the cases based on false allegations, as a result he has been behind bars for almost a year.’

The petition filed in the Lahore High Court has not been scheduled for hearing at present.

Imran Khan has referred to the decision of the Supreme Court of Pakistan in which a five-member bench had ruled that a civilian’s case cannot be tried in military courts.

This judgment was pronounced on the petition of Jawad S. Khawaja against the State of Pakistan.

It has been stated in the petition that ‘Supreme Court had declared that the trial of citizens was conducted by court martial.

This case shows how 103 accused were detained by the authorities in connection with the events of May 9, 2023.

This move was also illegal after which it is feared that the military authorities will also take Imran Khan into custody.

After the arrest of Imran Khan in an alleged corruption case by NAB on May 9 last year, during violent protests across the country, incidents of attacks on military installations and vandalism and arson of private and national properties came to light.

The government had decided to file a case against these persons in military courts under the Pakistan Army Act and the Official Secrets Act.
