Amendment of Election Act Cannot Overturn Decision of Specific Seats, Supreme Court – Pakistan

The majority judges of the Supreme Court issued another clarification on the issue of giving reserved seats to Pakistan Tehreek-e-Insaf (PTI).

On the request of the Election Commission, 8 judges issued an explanation. The decision of July 12 cannot be invalidated by the amendment of the opinion of the majority judges.

The judges have declared that the amendment of the Election Act will not be applicable from the past, the Election Commission is obliged to implement the court decision without asking for any further explanation.

The judges of the apex court said that we had issued a clarification even before passing the detailed judgment and we had given the right to approach for clarification so that there would be no problem in the execution of the summary decree.

In his explanation, he said that since the detailed decision has been issued, there is no need for any explanation and all the legal and constitutional points have been covered in the detailed decision.

He said that now that the Election Commission and PTI have filed applications for further clarification, we now clarify to the extent that the amendment of the Election Act does not invalidate our order.

It should be noted that the important consultation meeting on the issue of suspended members on specific seats under the chairmanship of the Chief Election Commissioner has ended.

The Election Commission had allotted specific seats, in which 15 Muslim League-N, 4 belonged to PPP and 3 to JUI-F, but they were declared vacant or disputed after the Supreme Court decision.
