The Korea Communications Commission has begun revising the enforcement ordinance for the separate collection of license fees for the Korea Broadcasting Corporation (KBS).

The KCC held its 19th committee meeting on the 14th and accepted the ‘partial amendment to the Enforcement Decree of the Broadcasting Act’ submitted as an agenda by the KCC Secretariat to the committee. The three-member committee voted on whether to accept the report agenda and passed it by a vote of 2 to 1. Acting chairman Kim Hyo-jae, a member of the government and ruling party, and member Lee Sang-in were in favor, and member Kim Hyun, a member of the opposition party, was once morest it.

Only 3 out of 5 members of the KCC attended the meeting. As Han Sang-hyeok, former chairman of the Korea Communications Commission, was dismissed, the chairman’s seat is vacant. Former lawmaker Choi Min-hee, whom the Democratic Party recommended as the successor to former standing member Ahn Hyung-hwan (vice chairman), is not being appointed by President Yoon Seok-yeol.

The Secretariat of the Korea Communications Commission is promoting a plan to separate KBS license fees from electricity rates by amending the contents of the Enforcement Decree of the Broadcasting Act. The main point is to amend Article 43, Paragraph 2 of the Enforcement Decree of the Broadcasting Act from ‘when a designated person collects a license fee, it may be done in conjunction with an act of notification related to the designated person’s own business’ to ‘must not do’.

Commissioner Kim Hyun criticized the KCC office for making a ‘hurried report’. Commissioner Kim said, “The enforcement decree is reported 6 days following the Presidential Office’s recommendation was delivered to the Korea Communications Commission on the 8th. Is there an example like this?” If accepting is not hasty, what is it?” he asked. He then put off accepting the amendment to the Enforcement Decree of the Broadcasting Act and demanded that it go through a deliberation process.

Commissioner Lee Sang-in said, “It is a good example to listen to various opinions from all walks of life, including the public, experts, and civic groups, and officially discuss improvement plans through discussions on the amendment to the Broadcasting Act (Enforcement Decree).” Subsequently, Commissioner Kim Hyo-jae expressed his consent, and the amendment to the Enforcement Decree of the Broadcasting Act was accepted as a report agenda. Commissioner Kim said, “It would be most desirable to reach an agreement, but if an agreement cannot be reached, a vote must be conducted.” Commissioner Kim Hyun left, saying, “Ignore the law and the Constitution and proceed with the meeting.”

After Kim Hyeon resigned, the two remaining members elected Kim Hyo-jae as vice chairman. Commissioner Kim Hyo-jae will serve as vice chairman until August 23, the expiration date of her term.

The Korea Communications Commission plans to make a legislative announcement of the amendment to the enforcement ordinance this month, and go through procedures such as consultation with related ministries and collecting opinions. After that, the revision will be completed within 3 months following the approval of the President following the KCC resolution, review by the Ministry of Government Legislation, deliberation and resolution at the Vice Ministers’ Meeting and the State Council.

In a statement that day, KBS said, “The basis for maintaining KBS as a public broadcaster even with a license fee of 2,500 won, which is incomparably lower than that of other competing countries, is the integrated taxation method that has proven to be the most efficient.” It is strongly regrettable that the National Communications Commission started the revision work 9 days following the recommendation of the President’s Office, even causing controversy over the procedural legitimacy.”

The media union also issued a statement, saying, “It is difficult to find a precedent for a swift decision on a controversial agenda in such a deformed structure since the establishment of the Korea Communications Commission.” It clearly shows that it has degenerated into a ‘committee’.”
