Alleged Plagiarism by Boyamin Saiman’s Son at MK Deemed Unethical – 2024-07-30 20:45:53

Syarif Hidayatullah University student, A Fahrur Rozi, who is the applicant for a judicial review of the age requirements for regional head candidates in Article 7 paragraph (2) letter e of the Regional Election Law at the Constitutional Court (MK) regrets a similar application submitted by the son of the Coordinator of the Indonesian Anti-Corruption Society (MAKI) Boyamin Saiman, Arkaan Wahyu Re A. The reason is, there are allegations of plagiarism committed by Arkan regarding Fahrur’s version of the application.

One of the similarities is in the applicant’s reasons. Based on monitoring by Media Indonesia, Arkaan’s version of the applicant’s reasons are exactly the same as those made by Fahrur and his colleague, Anthony Lee, who is a student at Podomoro University. Fahrur-Anthony are listed as applicants for Case Number 70/PUU-XXII/2024.

As the applicant who first filed a judicial review to the Constitutional Court, Fahrur said that his party questioned the credibility of Arkaan’s attorney. In the application letter, it was known that Arkaan used the services of the Legal Aid Association for Justice (PBH Peka) located in Surakarta, Central Java.

“From the perspective of legal professional ethics, as an advocate, this is not very ethical as a legal practitioner. Moreover, the applicant is a student, Arkaan, as an academic where this kind of plagiarism is forbidden by law,” Fahrur told Media Indonesia, Tuesday (30/7).

In addition, he also questioned the motive of the judicial review conducted by Arkaan. For him, it is necessary to investigate whether Arkaan’s motive really came from the awareness of the loss of constitutional rights as a citizen or simply social climbing or pansos from the developing political issue.

This suspicion cannot be separated considering that Arkaan’s older brother, Almas Tsaqibbiru, previously made history in the political path of Gibran Rakabuming Raka as the elected vice president in the 2024 presidential election. The reason is, Gibran can be registered as a vice presidential candidate because Almas is in accordance with the Constitutional Court’s decision regarding the age requirements for presidential and vice presidential candidates proposed by Almas.

“We certainly do not want a case that has the same typology of political gimmicks as case 90/PUU-XXI/2023 (filed by Almas) to happen again. We all certainly do not want there to be legal gimmicks in this kind of testing,” said Fahrur.

Both Fahrur-Anthony and Arkaan asked the Constitutional Court to state that the minimum age requirement for gubernatorial and vice gubernatorial candidates, namely 30 years, and 25 years for regent-vice regent and mayor-vice mayor candidates, is calculated from the time the candidate pairs are determined.

Article 7 paragraph (2) letter e of the Regional Election Law previously received a change in interpretation by the Supreme Court (MA) regarding the judicial review filed by the Garuda Party. The MA changed the calculation of the minimum age requirement for regional head candidates to since being inaugurated as the elected candidate pair. (Tri/Z-7)
