Alert: false, the former President of the Republic, Joseph Kabila, was not arrested by the ICC

Last updated Feb 22, 2024

False, the former President of the Republic and senator for life, Joseph Kabila, was not arrested by the International Criminal Court, contrary to what this allegation states.

The latest news is that Joseph Kabila is in Johannesburg, South Africa, for his academic program, as announced by his communications advisor, Barbara Nzimbi, on her X account (ex-Twitter). This is also the reason why he did not respond to Félix Tshisekedi’s invitation for his inauguration.

In 2019, similar misinformation was shared several times on social media. Contacted by Agence France-Presse, the International Criminal Court denied the assertion that “Félix Tshisekedi has just met with ICC agents in Brussels to affix his signature for the arrest of Joseph Kabila”.

“This is completely false information. No arrest warrant has been issued by the ICC once morest former President Kabila,” Fadi El-Abdallah, spokesperson for the ICC, told AFP.

How does the ICC work within the framework of cooperation?

As a judicial institution, the ICC does not have its own police or repression forces; it therefore depends on the cooperation of countries around the world to support its work, in particular to make arrests, transfer those arrested to the ICC detention center in The Hague, freeze the assets of suspects and carry out sentences, explains the Court on its website.

Although not an organization affiliated with the United Nations, the Court has entered into a cooperation agreement with the UN. When a situation does not fall within the jurisdiction of the Court, the UN Security Council can refer the situation to the ICC to exercise jurisdiction.

The ICC actively strives to promote mutual understanding and cooperation in all regions, for example by organizing seminars and conferences around the world. The Court collaborates with both States parties and non-States parties.
