Special prosecutors have decided to drop the appeal against Alec baldwin, effectively ending the criminal case against the actor.
The decision comes after a New mexico judge dismissed involuntary manslaughter charges against Baldwin in April. While the prosecutors, led by Andrea Reeb, have chosen not to pursue the case further, they expressed regret that Baldwin “will not be held accountable” for his role in Hutchins’ death.
“This has always been about seeking justice for Halyna Hutchins,” Reeb said in a statement. “We withdraw the appeal with the hope that the outstanding lawsuits bring some measure of justice to the family of Halyna Hutchins.”
Hutchins’ family, who reside in Ukraine, was consulted before the appeal was withdrawn and voiced their opposition to the decision.
The family is continuing to seek justice through a separate civil case against Baldwin and the film’s producers in a New Mexico state court.
Mary Carmack-Altwies, the elected district attorney in santa Fe, commended the prosecutors for their handling of the case. She highlighted the conviction of Hannah Gutierrez Reed, the film’s armorer, who was found guilty of involuntary manslaughter for loading a live bullet into Baldwin’s gun. Gutierrez Reed is currently serving an 18-month sentence.
The dismissal of charges against Baldwin has sparked debate about the legal complexities and accountability within the film industry. The tragedy has prompted a closer look at safety protocols on set, notably regarding the use of firearms and live ammunition.
“Halyna’s tragic death has prompted industry-wide scrutiny,specifically in New Mexico,of safety protocols,especially the use of firearms and live ammunition on set,” Carmack-Altwies said. “Halyna’s family set up the Halyna Hutchins Foundation to advocate for safer practices in the industry, promoting safety education and honoring her legacy as a talented filmmaker.”
Carmack-Altwies emphasized that the First Judicial District Attorney’s office remains committed to upholding justice and will continue to prosecute cases with integrity.
