AK Niederösterreich-Wieser: “Continued payment of wages applies beyond the notice period”

St. Pölten (OTS) In March, a salesperson called in sick – and was promptly terminated. However, the continued payment of wages does not necessarily end when the notice period expires, but also applies beyond that in the event of sick leave. The employer still refused to pay and claimed that the sick leave confirmation submitted was incorrect. “The man got support from the AK. This secured his claims for more than 13,000 euros,” says AK Lower Austria President and ÖGB Lower Austria Chairman Markus Wieser.

A salesman worked in the field for a company in the Mödling district for one and a half years. In March he called in sick and was fired ten days later. The 34-year-old was therefore entitled to eight weeks of full pay and a further four weeks of half pay – in his case until the end of his sick leave at the beginning of May. However, the company did not pay. The reason: The employer falsely claimed that the sick leave confirmation was incorrect. The employee therefore turned to the AK for help.

It quickly became clear: continued payment of wages was not the only thing that the former employer withheld. Because the man was never paid the agreed commission as well as extra hours and overtime. At the Mödling district office, his claims were recalculated and intervention was made on the employee’s behalf with his former employer. “After initially not being transparent, a lawsuit was filed. Ultimately, the employer paid 13,000 euros in additional claims,” says Wieser
