What does the law say?

Lawyer Ayman Mahfouz, who quashed the conviction, said a positive sample was strong evidence to convict anyone charged with drug offences, and was an aggravating factor for other crimes such as murder and negligent wounding.

But he emphasized that “if the arrest and search procedures are invalid, or the defendant is not in an active criminal state, the positivity of the sample itself is not a reason or some evidence that leads to the defendant’s conviction, and therefore, the positivity rate of the sample will not be considered.”

“Mahfouz” explained to Masrawy that, as for the player Ahmed Fattouh, “the arrest and analysis were carried out legally”. He pointed out that Article 34 of the Criminal Procedure Code allows judicial officers to order the arrest of a defendant who is present when there is sufficient evidence in the case of an active crime involving a felony or misdemeanor punishable by more than three months’ imprisonment.
