Agnelli legacy, hard blow for Margherita in the lawsuit with her children –

The cause for Gianni Agnelli’s legacy continues unabated, with news that makes Lapo, John and Ginevra Elkann smile and deals a hard blow to Margherita Agnelli, mother of the three. As Milano Finanza reports, this judicial line concerns the methods of registration of Dicembre’s shareholders – 60% owned by John and the remainder divided in half between the other two brothers – in the company register. “For almost twenty years that company created in 1984 which guards the treasure of the Agnelli-Elkann dynasty has remained shrouded in mystery, no articles of association, secrecy regarding the owners and their shares, no balance sheet”, explains the economic daily, which traces the stages of the legal battle.

“The formal issue is that the documents underlying the ownership of membership deposited in the Chamber of Commerce were not presented in original or with a copy conforming to the original, the notary has certified that they are ‘in conformity with the document exhibited’”, the crux of the dispute, with the Turin registry court which however on 26 April ruled in favor of the three Elkann. The judge of the Registry, Enrico Astuni, explained everything: “The control of the conservator is not completely eliminated but brought back to formal control only, being, instead, the qualification and legitimacy control already necessarily carried out by the notary who rogates or who authenticated the private writing”. But some problems remain. What are the consequences of this entanglement?

That, MF states, “the three Elkann are the only heirs of Marella and Margherita is not a member of Dicembre”. The Margherita Agnelli front are ready to appeal and also call into question the notary linked to the matter, while the three Elkann brothers show satisfaction with what the judge decided.
