“In El Salvador everyone knows that immediate presidential re-election is unconstitutional†: Enrique Anaya 2024-02-15 10:02:37

This Friday in the Encuentro interview with Julio Villagrán, lawyer Enrique Anaya, carried out an analysis of the situation that exists prior to the presidential and deputy elections of the Legislative Assembly, and possible consequences following the results of the electoral elections.

Anaya considered that the current situation leaves a regrettable panorama because from the legal perspective the constitutional rules are being broken, where the wrong message is being sent to the citizens that it is okay to break the rules, as what is has been carried out since this legislature assumed the Legislative Assembly, illegally replacing magistrates of the Constitutional Chamber, who subsequently approved the presidential re-election.

“The people who are in the Constitutional Chamber are not magistrates, they are usurpers. Where there is no judicial independence there is no democracy. On the other hand, “The Supreme Electoral Tribunal did not exercise the obligations that constitutionally corresponded to it, and washed its hands saying that the Constitutional Chamber had endorsed the presidential re-election.”Anaya said.

The lawyer pointed out that the TSE magistrates had several options to vote once morest the reelection, including applying article 235 of the Constitution of the Republic, which states that every civil or military official; Before taking office, he will protest under his word of honor, to be faithful to the Republic, to comply with and enforce the Constitution, or to say that the resolution of the “usurpers” was not applicable.

Regarding the citizens supporting the presidential re-election, Anaya pointed out that in El Salvador everyone knows that the immediate presidential re-election is unconstitutional, and that there cannot be a hidden article that supports it as indicated by the vice president of the Republic, Fé© lix Ulloa, since it has existed since 1841.

“Things are right or wrong regardless of how many people agree on something… The Salvadoran on the street knows that re-election is unconstitutional.â€Anaya assured.
