Adoption of new provisions relating to payment terms

This bill, presented by the Minister of Industry and Trade Ryad Mezzour, comes in execution of the High Guidelines of His Majesty King Mohammed VI who, in the royal speech on the occasion of the 65th anniversary of the Revolution of the King and the People, on the issue of payment deadlines which hinders the normal functioning of companies, indicated the Minister Delegate in charge of Relations with Parliament, government spokesperson, Mustapha Baitas, during a press briefing held following the Board meeting.

The said project, he continued, is part of the efforts made by the executive to deal with the late payment in order to achieve the revival of the national economy and improve the business climate.

The purpose of this bill is to remedy the shortcomings and obstacles that hinder compliance with payment deadlines, since it provides for provisions fixing the deadline for payment of claims on transactions at 60 days in the event that the parties concerned do not have not agreed on a deadline. It must not exceed 120 days when the parties concerned set a contractual deadline and this, from the date of issue of the invoice.

According to the Minister, this project includes legal provisions enacting a system of periodic reporting to the Administration, by electronic means, relating to unpaid invoices within the deadlines, those paid totally or partially outside the deadlines, in addition to unpaid invoices and making subject of dispute before the court, with the identification of the persons concerned by this declaration and the granting to the Administration of a credibility check of the declarations and the determination of the procedures for this control.
