The accused was found unanimously guilty as charged today, Thursday, October 17, by the Mixed Court of Appeal in Chania, for the murder and rape of Susan Eaton in July 2019.
From the defense side, recognition of mitigating factors was requested for good behavior throughout the period of his detention as well as for a previous clean criminal record.
The court rejected the mitigating circumstances and decided unanimously for the first act of intentional homicide a sentence of life imprisonment, for the second act of rape, by majority a sentence of 13 years and for the third act of illegal possession of a weapon unanimously 3 months, reports the website flashnews.gr .
Catapult the prosecutor
Earlier he had suggested his guilt and the prosecutor who stated that “the accused being fully aware of what happened to satisfy his sexual urges chose and carried out with complete sobriety the homicide and the rape without any doubt. With these thoughts the sufferer had the misfortune to be in the path of the accused and meet a martyr’s death and I think you should declare him guilty”.
The prosecutor a few minutes earlier had started his proposal with the two charges against the defendant in the case of the homicide of the biologist Susan Eaton.
The prosecutor notes in his motions that the defendant never raised any plea of impeachment. He is presented, as he claimed, as a special personality who deals with magic and martial arts, but that’s all, while there is no evidence that he was unaccounted for.
The prosecutor then stated that “his confession and what he told the investigator and during the preliminary investigation are identical with findings that were later found on Eaton’s body. In his statements, the defendant proceeds with exhaustive descriptions and no one could have forced him, as he claims, to say all this. He describes them because he himself has fully experienced them. The accused belatedly denies the rape.”
The district attorney described what unfolded on July 2 and stated that in his opinion “Suzanne Eaton’s death occurred after she fell from a height of nearly 7 meters into the cave.”
The defendant’s plea
Earlier, the accused in his apology spoke of a tragic car accident while denying the act of rape attributed to him. At the same time, he claimed that he had been forced to confess to the act of rape before the investigation and to the investigator. The defendant continued his plea by describing what happened that day.
Specifically, he said: “I had gone to collect firewood in Tavronitis that day, my cell phone had no battery and I left it at home. It was very hot and I got tired and went for a ride in the car. Going towards Afrata I saw her running on the side of the road on the left. I didn’t know her. I was running with the car because I thought there was no one else on the road. Then at the turn of the road I saw Susan running and she went to pass probably on the other side of the road she didn’t look, I didn’t have time to react, I swerved to the right to avoid her and I hit her with the driver’s side of the knees. The car took her from underneath and she was trapped. I stopped, got out of the car and saw her not talking, only shaking. Then I reversed to free her. I went down to see if he was alive, if he was breathing, he was breathing.”
The defendant then continued describing what happened next.
Specifically, he said “the first thing I thought was to take her to the police or the hospital. At the last moment I saw her and thought that if she happens to die before I see her I shall not have time to go home and see my children again. I thought because I knew this point very well to throw her there to delay a little so that I could live a little with my family. I took an umbrella cover put it in the trunk and put her there. I thought before throwing her away that it is wrong but the other thought of spending some time with my family took over. I dragged her by the legs and let her fall down into the cave. then I sat in the car for a long time thinking about how to handle it. I also threw away the fabric of the umbrella. The trunk was also stained with blood. I went straight to Tavronitis to get the wood I had left to go home. Before I went to Tavronitis for the wood, I had gone to Maleme to the cemetery and washed the car inside and out as much as I could so that it wouldn’t smell of blood. I couldn’t think straight.”
