Jayne was housed at the PI Utrecht, the official designation for the Nieuwersluis prison. During her incarceration, the two guards in question were on duty as correctional officers, seemingly violating their codes of conduct.

The first accused, identified as a male in his sixties, faces serious charges, including rape and sexual assault. His colleague, also in his sixties, is implicated for sexual assault.

Abused

In total, five women have alleged abuse, with Jayne being one of the foremost voices in the case. She witnessed the misconduct within the facility and, tragically, became a victim herself. The incidents unfolded approximately two years ago in a secured office space within the prison. “I had a pro forma hearing and wanted to prepare for it,” Jayne explained. “I had a report that required updating and needed to go to J’s office for that.”

This J., an employee of the institution, has not been accused of any wrongdoing. In fact, detainees are ordinarily prohibited from entering J.’s office. “However, I was also a cleaner, so I frequented the area,” Jayne elaborated. “When I got to the office, W. was present too. I initiated a discussion with J., but W. started harassing and cursing at me. He commanded me to leave and simply didn’t stop.”

Bruises

“I asked him to stop as I had something important to discuss. When he persisted, I became frustrated and retorted, ‘Fuck off.’ At that moment, I was leaning over J.’s desk when W. seized me from behind and forcefully ejected me from the office, leaving me with bruises on my neck, shoulder, and arm.”

Jayne expressed that the reaction from W. was completely disproportionate to the situation. “I felt as though I had done nothing wrong; I wasn’t the one exhibiting aggression,” she stated. Following the incident, she requested a meeting with the prison’s manager, Adri, who subsequently arranged for her medical evaluation.

After consulting with her attorney, Jayne made the brave decision to file a report against W. However, she was far from alone in this ordeal. Reports indicate that W. had inappropriate encounters with at least four other women, with one individual even accusing him of rape.

According to Jayne, the atmosphere within the prison indicated regular misconduct that should not have been tolerated. “As a cleaning lady, I had a unique vantage point,” she noted. “Guards would often ‘accidentally’ collide with female inmates. There were instances of women being pinched on the buttocks or breasts, which is entirely unacceptable.”

Fear of consequences

Jayne revealed that many women had lodged complaints regarding the guards’ behavior, yet several remained silent due to fears of repercussions. “They were particularly concerned that the guards would retaliate by entering their cells. If I sensed that was their intention, I would deliberately walk by with my mop or cleaning rag to disrupt their plans.”

While Jayne herself did not experience overt physical sexual violence during her time in prison, she faced troubling encounters with guards. “There were moments when I exited the shower only to find them standing there, leering at me.”

After bringing her allegations to light, Jayne found it increasingly stressful as she felt she had to be on constant guard. “The situation was incredibly tense, as I lived in fear of them targeting me in retaliation.” This sense of dread only subsided last July when she was finally allowed to leave the facility.

Research

Reports of abuse within PI Nieuwersluis are not recent developments. An investigation from the Justice and Security Inspectorate unveiled last year that serious violations had occurred within the prison’s walls. “There exists a culture that permits prison staff to engage in unethical behaviors, including sexually inappropriate actions. The environment is unsafe, both for detainees and for the employees,” declared Esther de Kleuver, Inspector General of the Inspectorate, at that time.

Today marks a pivotal moment as it signifies the first instance where prison guards are facing trial for their alleged crimes. While Jayne welcomes this step towards justice, she is equally critical of the prison management’s apparent negligence. “It was profoundly disappointing that the director did not take the initiative to communicate with the inmates regarding the turmoil occurring within her institution, which has undoubtedly incited stress, unrest, and trauma.”
