‘Aadhaar cannot be verified while having sex’; Court granted bail to POCSO case accused

Delhi High Court says Aadhaar card cannot be checked while having sex. The court also observed that there is no need to verify the date of birth before consensual intercourse. The court observed that the accused in the case of raping a minor girl was granted bail.

The court said that the age cannot be checked by looking at the partner’s Aadhaar card, PAN card or school certificate before having sex. There is no need for it. It is doubtful whether this is a case of extortion following consensual sex. The complainant has different dates of birth in various documents. The suspicion of the accused that this is a move to implicate him in the case by showing a wrong date of birth is reasonable. Date of birth of the complainant is 01.01.1998 in Aadhaar card. Therefore, the complainant was of age when the incident took place. A large amount of money has come into their account. It should be investigated whether this is a case of honey trap. The court directed the police commissioner to investigate the different dates of birth and the money in the account. The court also said that they should find out whether they have made such allegations once morest anyone else.

The court directed the accused to be bailed on a bond of Rs 20,000. Sign at the police station at regular intervals. In the bail conditions, the court said that he should not leave the country and keep his passport.
