A Cipolletti woman admitted that she made obscene exhibitions to a 2-year-old girl who was in her care while her mother worked. It happened between the end of 2016 and the beginning of 2017, but the unveiling happened five years later. The victim recognized her on the street and told her mother’s friend that he was with her: “…it was bad and she had bad memories…”.
That girl’s story led to a criminal complaint filed by her mother. After a series of interviews with professionals, the victim testified in the Gesell Chamber and was able to detail the behavior of the accused. She said that the condemned woman showed her her private parts. From the judgment it appears that the original accusation was also for sexual abuse, but it was not possible to prove that crimefor which it derived only in obscene exhibitions.
After several instances of negotiation, the parties reached an agreement and the woman was sentenced to six months in prison suspended and a series of behavior guidelines that she must comply with to remain free, including not having any type of contact with the victim and his entourage by any means. The complaint was made on February 17, 2021 and the abbreviated trial was held on March 8, by Judge Florencia Caruso.
Two Ofavi professionals met twice with the minor, the first prior to the Cámara Gesell interview in which they stated that she was in a position to testify and that she might understand what was happening.
There she recounted that the defendant was taking care of her and that she lowered her pants and also lowered her own and saw where she was peeing, showed her her private parts, ”says the ruling.
The prosecutors in charge of the process were Eugenia Vallejos and Vanina Bravo, and the surrogate defense attorney for minors also participated in the hearing: Lilian Rodriguez. Michel Rischmann was in charge of defending the defendant. His identity is reserved to preserve the identity of the victim who is nine years old today.
“After listening to the parties, proceed to resolve orally and immediately, provided that there is full agreement of the parties, I made it known that the abbreviated trial has as its starting point the Prosecutor’s accusation of the criminal act attributed to the accused who in turn admitted having committed it,” said Judge Florencia Caruso, who approved the agreement between the parties.
