The UAE government has warned employers that non-compliance with the new regulations on employees may result in fines of up to 1 million riyals.

According to the Khaleej Times report, under the federal order, employers will be fined up to 10 lakhs for the following violations.

  • Employing a person without a work permit or bringing in a person without providing employment
  • Closing the business without settling the rights of employees or workers
  • Engaging in fraudulent activities including fictitious employment or fictitious employment
  • Employing a minor in violation of law
  • Engaging in any act in violation of laws or regulations governing the labor market, including fictitious employment

According to the new provisions, the penalty amount may also increase based on the number of workers working on the fictitious basis.

Additionally, the Ministry of Human Resources and Emirates is now authorized to make a settlement provided that the employer pays at least 50 percent of the fine and returns the financial incentives received by the fake employees to the government.

With the implementation of the provisions, the Appellate Court will be required to refer to the First Court all applications, disputes and complaints relating to the regulation of employment relations.
