An appeals court validates the end of the prosecution against Trump for withholding classified documents

Special prosecutor Jack Smith is following a Justice Department policy of not prosecuting a sitting president.

A US federal appeals court on Tuesday validated special prosecutor Jack Smith’s request to drop charges against Donald Trump for withholding classified documents after leaving the White House in 2021.

Jack Smith, who is investigating this case, announced on Monday that he would withdraw his appeal against the decision of Judge Aileen Cannon, in Florida, canceling the procedure on July 15 on the grounds that the appointment of the special prosecutor in this case was unconstitutional.

He explained that he complied in this way under a policy of the Ministry of Justice consisting of not prosecuting a sitting president and applied to this “unprecedented” situation of a criminal defendant elected president.

A federal appeals court therefore approved the withdrawal of this appeal, however only regarding Donald Trump. The special prosecutor maintained his appeal regarding the two other defendants, personal assistants to Donald Trump at his Mar-a-Lago property.

Donald Trump had compromised national security

In this case, one of four criminal proceedings targeting him, Donald Trump was accused of having compromised national security by keeping documents, including military plans or information on nuclear weapons, in his private residence after the end of his mandate, instead of handing them over to the National Archives, as required by law.

He was also accused of attempting to destroy evidence. The heaviest charges were punishable by up to 10 years in prison.
