The Court judge in Pakistan history ayesha malik chief justice | ayesha malik twitter | ayesha malik facebook”>Lahore High Court ordered the release of Parvez Elahi. Lahore High Court heard the petition filed against the arrest of Parvez Elahi in NAB. Justice Amjad Rafique heard the petition of Pervez Elahi.
During the hearing, Justice Amjad Rafiq said that there will be an inquiry on the arrest of Parvez Elahi, when the decision of the two-member bench was reached, then why was the physical remand extended? Lawyer Pervaiz Elahi requested the court that there is a lot of crowd outside the High Court, there is fear that the police will arrest them.
Justice Amjad Rafiq replied that we have said that we will not arrest in any case, I am also ordering the rest. Parvez Elahi had challenged the NAB arrest in the High Court. The court had ordered Parvez Elahi to appear before the court at ten o’clock.
NAB Lahore had written a letter to IG Punjab and others for Parvaizalhi’s security.
Earlier, a hearing was held in the Lahore High Court on the petition filed against the arrest of former Chief Minister Chaudhry Pervez Elahi by NAB. Justice Amjad Rafiq heard the request of Pervaiz Elahi.
During the hearing, the NAB prosecutor said that time should be given for a detailed response to the request of Chaudhry Parvez Elahi, Justice Amjad Rafique remarked that it is fine, then we order Parvez Elahi to be deported.
The court told the NAB officials that you should request the Chief Justice that this request be fixed for hearing before a 2-member bench. Is the arrest of the former Chief Minister of Punjab in accordance with the law?, all the questions are to be answered in your reports.
The NAB prosecutor argued that the single bench did not give a direction not to arrest Parvaiz Elahi.
The Prosecutor General said that it is in the decisions of the Supreme Court that a two-member bench can hear the cases of NAB, a single bench cannot hear the cases of NAB, it is the work of the subordinate courts to implement the decisions of the Supreme Court. Give respite, we will submit a full detailed report to the court.
The NAB prosecutor objected to the appearance of Amjad Parvez on behalf of Parvez Elahi and said that Amjad Parvez does not have a power of attorney in this case.
The court remarked that it seems like this is a personal matter of yours. The NAB prosecutor said that Amjad Parvez himself is the special prosecutor of NAB, how can he appear?
Amjad Pervez said that I represent NAB only in specific cases. Justice Amjad Rafiq said you should start the arguments, the court is giving permission, if you want me not to hear this case, then apply to the Chief Justice.
Justice Amjad Rafiq remarked that the arrest of Parvez Elahi is in accordance with the law, when the two-member bench restored the decision of the single bench, then the decision of the single bench is upheld, the law is very clear in this regard, we have to decide now. Parvez Elahi’s arrest is legal or illegal.
Lahore High Court ordered to present former Chief Minister Punjab and PTI leader Chaudhry Pervez Elahi in court at 2 pm, however NAB decided not to present Chaudhry Pervez Elahi in court.
It should be noted that Chaudhry Parvez Elahi has requested NAB to declare his arrest as illegal.

**Interview with Legal Expert Dr. Aisha Khan on the Lahore High Court’s Ruling in the Parvez Elahi Case**
**Interviewer:** Welcome, Dr. Khan. Thank you for joining us today to discuss the recent ruling by the Lahore High Court concerning Chaudhry Parvez Elahi. Can you provide us with an overview of why the court decided to release him?
**Dr. Khan:** Thank you for having me. The Lahore High Court’s decision to release Parvez Elahi stemmed from a petition challenging his arrest by the National Accountability Bureau (NAB). During the proceedings presided over by Justice Amjad Rafique, the court raised concerns about the legality of the physical remand that had been extended after a decision signaling an inquiry into the arrest was reached. Justice Rafique highlighted the need for clarity regarding whether the arrest was conducted in accordance with the law [[1](https://tribune.com.pk/story/2467659/ptis-pervez-elahi-released-says-i-am-was-and-will-be-with-imran-khan)].
**Interviewer:** What specific arguments did the defense present that influenced the court’s ruling?
**Dr. Khan:** Elahi’s legal counsel highlighted a tense situation outside the High Court, indicating fears of further arrests, which likely pressured the court to ensure the proceedings were conducted fairly and without undue influence from law enforcement. The court’s assurance that no additional arrests would occur during this inquiry period played a crucial role in its decision [[1](https://tribune.com.pk/story/2467659/ptis-pervez-elahi-released-says-i-am-was-and-will-be-with-imran-khan)].
**Interviewer:** How did NAB respond during the hearing?
**Dr. Khan:** The NAB prosecutor requested more time to formulate a detailed response to Elahi’s petition. However, the court was inclined to expedite the process, signifying that they were not satisfied with the NAB’s handling of the situation. Justice Rafique remarked that the essential legal inquiries regarding the nature of the arrest and subsequent remands needed to be addressed promptly [[1](https://tribune.com.pk/story/2467659/ptis-pervez-elahi-released-says-i-am-was-and-will-be-with-imran-khan)].
**Interviewer:** Moving forward, what implications might this ruling have for Elahi and similar cases in Pakistan?
**Dr. Khan:** This ruling not only impacts Elahi directly but also sets a precedent for how future arrests can be scrutinized by the courts. It illustrates the judiciary’s willingness to challenge the actions of accountability agencies and emphasizes the importance of legal protocols in arrests. This may encourage other political figures facing similar circumstances to pursue legal avenues to contest their arrests [[1](https://tribune.com.pk/story/2467659/ptis-pervez-elahi-released-says-i-am-was-and-will-be-with-imran-khan)].
**Interviewer:** Thank you, Dr. Khan, for sharing your insights on this significant legal matter. It certainly raises many questions about the balance of power between legal authorities and accountability bodies in Pakistan.
**Dr. Khan:** My pleasure. It’s a critical discussion, and developments like these are vital for the rule of law in the country. Thank you for having me.
