Fluc Up Tool Terms and Conditions
Section 12 of General Terms and Conditions
12.1 The Fluc-Up Tool, along with any Bets associated with its functionality, will be regulated by these General Promotional Terms and Conditions. This governance extends to include the Account and Betting Platform Terms of Use, as well as the specific Betting Rules, ensuring a comprehensive framework for use.
12.2 NEDS retains the full discretion to provide the Fluc-Up Tool exclusively to eligible Customers, organizing its availability around selected markets, events, or types of Bets that it deems appropriate.
12.3 The utilization of the Fluc-Up Tool cannot be paired with any other Promotional Offers or Promotional Tools, thereby creating a distinct betting experience focused solely on the benefits provided by the Fluc-Up Tool.
12.4 The Fluc-Up Tool is strictly designated for single ‘win’ Bets only. Customers should note that the ‘win’ component of an each-way Bet will not qualify for the application of the Fluc-Up Tool, thereby limiting its use to straightforward win scenarios.
12.5 The Fluc-Up Tool is not applicable for ‘Multi-Bets’, ‘Exotic Bets’, or ‘Future Bets’ as defined within the NEDS Betting Rules, ensuring clarity in the types of Bets compatible with this tool.
12.6 The maximum eligible Bet that can be utilized with the Fluc-Up Tool is capped at $500.00, providing a clear limit on the extent of potential engagement with this promotional feature.
12.6 The Fluc-Up Tool is exclusively accessible for use on Eligible Australian and New Zealand metropolitan racing events, which include thoroughbred gallopers, trotters, and greyhounds, thus tailoring its application to specific and popular racing formats.
12.7 The Fluc-Up Tool can only be employed for Bets placed directly on the Neds Betting Platform, whether accessing through the desktop version or the Neds smartphone App. It is essential to note that this tool is not available for Bets made via telephone, thereby streamlining the process through digital channels.
12.8 The Fluc-Up Tool may be applied only once for each race, ensuring that its availability is limited to a single use to enhance the strategic aspect of betting.
12.9 If the Fluc-Up Tool is made available for your eligible Bet, then:
(a) you will observe the Fluc-Up Tool button/icon located directly beneath your selection on your ‘Quick Slip’;
(b) After your Bet on the chosen selection is accepted and appears in your Bet Slip, you will have the option to activate the Fluc-Up Tool by clicking on the ‘Fluc-Up’ button/icon, referred to as the ‘Fluc-Up Request’;
(c) Your request to utilize the Fluc-Up Tool must be submitted within a critical 5 minutes following the acceptance of your Bet, as indicated by the countdown timer adjacent to your selection in the Bet Slip, marking this as the ‘Fluc-Up Activation Period’;
(d) Should your Fluc-Up Request be submitted within the designated Activation Period, then if the market odds for your selected runner shift upwards at any moment during this timeframe (in compliance with the market fluctuation data exhibited on the Betting Platform), the odds for your selection will be automatically adjusted to the next highest fluctuating odds at the moment in which the Bet was placed. Thus, if your selection results in a win, you will be compensated at the revised higher odds instead of the original lower odds.
12.10 Your Fluc-Up Request will remain unapproved and unprocessed by NEDS until you receive a formal confirmation in your Bet Statement, providing assurance of the request’s status.
12.11 Once a Fluc-Up Request is successfully made and processed, the Fluc-Up Tool will be considered used, regardless of whether there was any upward market fluctuation in odds on your selection during the Activation Period, indicating the finality of your request.
12.12 If there is a timeout, or other intermittent connectivity failures occur between submitting a Fluc-Up Request and receiving the confirmation of its acceptance or rejection (termed as ‘Pending Request’), you may be restricted from utilizing the Fluc-Up Tool for another Bet until the status of the Pending Request is clearly displayed in your Bet Statement.
12.13 Each eligible customer will be designated a fixed quota of times for using the Fluc-Up Tool within a 24-hour timeframe, at the absolute discretion of NEDS. Each quota allowance will reset at midnight (AEST) daily, meaning any unused options for that day will expire and will not be carried over to the following day.
12.14 You can only use the Fluc-Up Tool once per race. Should there be a timeout or intermittent failure of connection to the Neds Betting Platform after activating the Fluc-Up Tool for a race, the tool will be considered consumed and unavailable for any additional Bets for the remainder of that day.
12.15 NEDS reserves the authority to modify, suspend, or entirely remove access to the Fluc-Up Tool at any time, allowing for flexibility in service offerings.
12.16 NEDS holds the right to nullify any Bets placed utilizing the Fluc-Up Tool if it detects any obvious and manifest errors on its part and/or identifies any breaches of the Terms and Conditions by the Customer.
