The Lahore High Court ordered the release of Parvez Elahi. Lahore High Court heard the petition filed against the arrest of Parvez Elahi in NAB. Justice Amjad Rafique heard the petition of Pervez Elahi.
During the hearing, Justice Amjad Rafiq said that there will be an inquiry on the arrest of Parvez Elahi, when the decision of the two-member bench was reached, then why was the physical remand extended? Lawyer Pervaiz Elahi requested the court that there is a lot of crowd outside the High Court, there is fear that the police will arrest them.
Justice Amjad Rafiq replied that we have said that we will not arrest in any case, I am also ordering the rest. Pervaiz Elahi had challenged the NAB arrest in the High Court. The court had ordered Parvez Elahi to appear before the court at ten o’clock.
NAB Lahore had written a letter to IG Punjab and others for Parvaizalhi’s security.
Earlier, a hearing was held in the Lahore High Court on the petition filed against the arrest of former Chief Minister Chaudhry Pervez Elahi by NAB. Justice Amjad Rafiq heard the request of Pervaiz Elahi.
During the hearing, the NAB prosecutor said that time should be given for a detailed response to the request of Chaudhry Parvez Elahi, Justice Amjad Rafique remarked that it is fine, then we order Parvez Elahi to be deported.
The court told the NAB officials that you should apply to the Chief Justice that this application be fixed for hearing before a 2-member bench. Is the arrest of the former Chief Minister of Punjab in accordance with the law?, all the questions are to be answered in your reports.
The NAB prosecutor argued that the single bench did not give a direction not to arrest Parvaiz Elahi.
The Prosecutor General said that it is in the decisions of the Supreme Court that a two-member bench can hear the cases of NAB, a single bench cannot hear the cases of NAB, it is the work of the subordinate courts to implement the decisions of the Supreme Court. Give respite, we will submit a full detailed report to the court.
The NAB prosecutor objected to the appearance of Amjad Parvez on behalf of Parvez Elahi and said that Amjad Parvez does not have a power of attorney in this case.
The court remarked that it seems like this is a personal matter of yours. The NAB prosecutor said that Amjad Parvez himself is the special prosecutor of NAB, how can he appear?
Amjad Pervez said that I represent NAB only in specific cases. Justice Amjad Rafiq said you should start the arguments, the court is giving permission, if you want me not to hear this case, then apply to the Chief Justice.
Justice Amjad Rafiq remarked that the arrest of Parvez Elahi is in accordance with the law, when the two-member bench restored the decision of the single bench, then the decision of the single bench is upheld, the law is very clear in this regard, we have to decide now. Parvez Elahi’s arrest is legal or illegal.
Lahore High Court ordered to present former Chief Minister Punjab and PTI leader Chaudhry Pervez Elahi in court at 2 pm, however NAB decided not to present Chaudhry Pervez Elahi in court.
It should be noted that Chaudhry Parvez Elahi has requested NAB to declare his arrest as illegal.

How does the recent re-arrest of Parvez Elahi after the court’s ruling reflect on the relationship between political influences and the judiciary in Pakistan?
**Interview with Legal Analyst on the Parvez Elahi Case**
**Host:** Welcome to our segment today where we discuss the recent developments surrounding Chaudhry Parvez Elahi and his legal challenges. We have with us legal analyst, Dr. Ayesha Malik, to provide insights into this complex situation. Thank you for joining us, Dr. Malik.
**Dr. Ayesha Malik:** Thank you for having me.
**Host:** To start, could you summarize the recent Lahore High Court ruling regarding Parvez Elahi?
**Dr. Ayesha Malik:** Certainly. The Lahore High Court recently ordered the release of Parvez Elahi following a hearing where Justice Amjad Rafiq addressed his petition challenging his arrest by the National Accountability Bureau (NAB). The court expressed concerns about the legality of his detention and indicated that there would be an inquiry into the circumstances of his arrest. Justice Rafiq questioned why his physical remand was extended if the High Court’s decision had not been finalized [[1](https://www.dawn.com/news/1773448)].
**Host:** That sounds quite significant. What were the main points raised during the hearing?
**Dr. Ayesha Malik:** During the hearing, the lawyer for Elahi expressed concerns for his client’s safety, noting the large crowd gathered outside the court, which raised fears of a potential arrest. Justice Rafiq responded firmly, assuring that no arrest would take place following their decision. This highlights the court’s attempt to ensure safety and uphold judicial integrity amidst a highly charged atmosphere [[1](https://www.dawn.com/news/1773448)].
**Host:** What does this ruling indicate about the relationship between the judiciary and law enforcement agencies, particularly the NAB?
**Dr. Ayesha Malik:** This ruling indicates a growing scrutiny from the judiciary regarding how law enforcement, particularly the NAB, conducts arrests. The court is signaling that it will closely examine whether arrests are made in accordance with legal norms. The justice system is expected to act as a check on the powers of agencies like the NAB to prevent misuse of authority [[1](https://www.dawn.com/news/1773448)].
**Host:** There have been reports of Elahi being re-arrested after the court ruling. Can you shed light on that situation?
**Dr. Ayesha Malik:** Yes, it seems that shortly after the Lahore High Court ordered his release, Elahi was re-arrested by the Islamabad police under public order laws. This may suggest an ongoing political influence surrounding his case, which complicates the legal landscape. The timing raises questions about the motives behind such actions and whether they are politically motivated or genuinely concern public safety [[1](https://www.dawn.com/news/1773448)].
**Host:** In light of these developments, what should we expect next in this case?
**Dr. Ayesha Malik:** Moving forward, we can expect further legal challenges from Elahi’s side as his team will likely contest the re-arrest. Additionally, the inquiry into the legality of the initial arrest could also lead to broader implications for NAB’s operations. The outcomes could influence future dealings between political figures and the accountability institutions [[1](https://www.dawn.com/news/1773448)].
**Host:** Thank you, Dr. Malik, for your insightful analysis on this evolving story. We appreciate your time.
**Dr. Ayesha Malik:** Thank you for having me. It’s important that we continue to follow these developments closely.
