The Corruption Eradication Commission (KPK) confirmed that the Governor of South Kalimantan (Kalsel) Sahbirin Noor is still a bribe recipient even though he is no longer a suspect. The results of the pretrial hearing have no influence on the material aspects of case management.
“Yes, so as I said earlier, this pretrial only tests the formal aspect, not the material aspect,” said KPK spokesperson Tessa Mahardhika Sugiarto at the KPK’s Red and White Building, South Jakarta, Tuesday (12/11).
Tessa explained that the pretrial also did not take into account the legal status of other suspects who had been determined by the Corruption Eradication Commission. The flow of more than IDR 12 billion that has been found is confirmed to be for Sahbirin.

The Corruption Eradication Committee (KPK) will immediately study the pretrial decision to continue legal action against Sahbirin. One of them is to issue another investigation warrant for him.
“We will see the progress of whether the information digging, extracting information carried out by investigators will be able to produce a new investigation warrant,” said Tessa.
The South Jakarta District Court granted the pretrial lawsuit filed by the Governor of South Kalimantan (Kalsel) Sahbirin Noor. His suspect status in the three project bribery case was revoked.

“Accepted and partially granted Sahbirin Noor’s pretrial lawsuit,” said Single Judge Afrizal Hady at the South Jakarta District Court, Tuesday, November 12 2024.
The panel decided that the Corruption Eradication Commission (KPK) had taken arbitrary action in naming Sahbirin as a suspect. The existing sprindik was declared invalid.
“Declaring Sprindik is invalid,” said the panel. (P-5)

**Interview with Tessa Mahardhika Sugiarto, KPK Spokesperson: Understanding the Implications of the KPK’s Confirmation on Sahbirin Noor**
**Editor:** Thank you for joining us today, Tessa. The recent statement from the KPK about Governor Sahbirin Noor has raised quite a few eyebrows. Can you clarify what exactly the commission found regarding his involvement in bribery?
**Tessa Mahardhika Sugiarto:** Thank you for having me. Yes, the KPK has confirmed that Governor Sahbirin Noor continues to be regarded as a bribe recipient. However, it’s important to highlight that the recent pretrial hearing concluded that he is not formally classified as a suspect at this moment. This can be confusing, but the pretrial decision only addressed procedural aspects, not the substance of the case.
**Editor:** That’s an interesting point. Can you explain what you mean by procedural versus substantive aspects in this context?
**Tessa Mahardhika Sugiarto:** Certainly. The procedural aspect pertains to whether the rights of the individuals involved are respected during the legal process. In this case, the court ruled on those formalities. However, the substantive aspect involves the actual evidence and facts of the case, which suggest that there is still a basis to consider Sahbirin Noor as a recipient of bribes, despite the pretrial outcome.
**Editor:** Does this mean that the KPK’s investigation into Sahbirin Noor is ongoing?
**Tessa Mahardhika Sugiarto:** Yes, exactly. The KPK is still actively investigating all matters related to this case. While the pretrial ruling does not impact our ongoing investigations or any future actions, we need to abide by the legal framework in how we approach our case management.
**Editor:** What message does this send to the public regarding corruption and accountability among public officials?
**Tessa Mahardhika Sugiarto:** Our stance is very clear: we are committed to combating corruption at all levels. Even if a public official is not a suspect, if there is evidence suggesting wrongdoing, we will pursue it. It’s important for the public to understand that accountability remains a priority, and we will continue to work diligently to ensure transparency in governance.
**Editor:** Thank you for your insights, Tessa. It sounds like there’s more to come in this situation.
**Tessa Mahardhika Sugiarto:** Absolutely, and we appreciate the public’s interest in holding officials accountable. We will continue to provide updates as our investigation progresses.
**Editor:** Thank you once again, Tessa.
